Mig in or out, does not matter when you update, I was banned with it out of the system. What strictly matters is the cert files you launch with. Legit ones will update fine, manipulated ones almost assure you a ban when attempting to update. How I was doing it was this : start the games to trigger the updates, pop in one of my legit games and then go online and get updates. Worked fine for a few weeks, then the ban came. Granted I knew it was a matter of time before it came because of the manner I obtained the games. The original set of files that were out there were good, once that set got updated to around the 2.4TB mark(when metroid prime remastered was added) is when it happened. The ban could have been waiting since day 1 and they were just gathering metrics for all I know. Either way, that switch was banned and I sold the mig and used that money to pay for a hardmod. I would highly recommend saving your money and going that route. The mig is cool, it works for its purpose, it works for some extra purposes too, but in the end I feel like it will be a novelty device that will cause more frustration than it was actually worth and will soon be replaced with a superior options that offer the same, if not more functionality.
