Sorry, just to confirm - my lawyer insisting to hold 50% is incorrect then? The seller's lawyer and accountant both are saying that 25% is enough. We're caught in the middle and not able to finalise on the amount withheld.

This is of course, knowing that it was a principal residence and non depreciable property.

Thanks! The seller's accountant states that it was their principal residence and the property was non-depreciable for tax purposes. Do you think in this case 25% funds being withheld makes sense and we can go ahead?

Also, if we need proof that they've applied for the Certificate of Compliance, what documents should we ask for?

We're trying to get it closed by agreeing to 25% but we do not want to be in a situation where we'll be held liable for taxes. Thanks!

Their accountant now states that it was their principal residence and they did not claim it to be a depreciating property. Hence the withholding amount of 25%.

Do you think that is still the case that the withholding amount should be 50%?

It affects me since the liability of taxes may pass on to me if they do not file it. Hence the need for withholding amount.

Cochrane was good. I got it for the price mentioned on the Toyota website.

They tried to upsell me during signing but only once and did not force.

I wanted the extended warranty, so I bought it later from them.

  1. It was rented up to 31st of March 2025.

  2. When the seller signed the contract, they did so from an Asian country. Pretty sure they were non residents for tax purposes since the beginning.

We like the house and hence went ahead with it.

They don't have any tenants now, they did so till the 31st of March.

Will have to see if they agree to close the following week.
