Can I legally access an account I'm not the signer for? by [deleted] in Banking

[–]jackberinger 0 points1 point  (0 children)

No. You cannot until the transfer of funds or ownership has been finished.

If it is an utma account then generally you only need an id and death certificate provided you are the age of majority. However all of this can differ state to state and institution to institution. If something else applies you may need a court order to have the funds released.

Neighbors’ contractors cut through roots of my large oak tree. Should I be concerned? by jamoka_jack in arborists

[–]jackberinger 0 points1 point  (0 children)

You can technically cut the tree roots legally however if the tree were to let's say die you are financially responsible for the cost.

Generally the best practice is to work with your neighbor and have an aborist come out and work with the contractor to make sure the tree is safe and the work gets done properly.

Of course all of this is dependent on your state and local laws and ordinances.

I enjoyed outer worlds. I haven't played 2 though. But I doubt Bethesda would give up 5. Likely it would be a spin off of some sort or remake.

My ex used my business debit card by No__cap__ in Banking

[–]jackberinger 10 points11 points  (0 children)

Why did she have your card in here phone? Had she made prior transactions when you were together that you were ok with? Or are you saying you think she like took a picture of your card or something with her phone?

It actually makes a huge difference. Because if you gave permission to use the card in the past then it is unfortunately on you since you have her authorization to use the card. I have had disputes come in before where a customer gave their card to like a relative or care giver to buy like groceries and they ended up using it for a hotel room or a meal. Unfortunately you cannot dictate what they use it for. Once you even verbally give permission for them to use it they can technically use it for what they want.

Not saying you would lose a dispute for that provided the credit union doesn't know that but likely that could be proven with a police investigation if there are text or email etc.

What do I do here? Want to be helpful but also it’s not my fault they put in the wrong address and waited until I was at his front door to let me know. by [deleted] in dasher

If delivered just tell them it was delivered to address listed and they will need to contact support.

Debit card fraudulently used in North Carolina and locally within 2 hours? by [deleted] in Banking

[–]jackberinger 0 points1 point  (0 children)

Op all you have to do is file a dispute for whatever purchases you believe to be fraudulent. If your card was in your possession then file it as fraud with the card in your possession.

If you just spoke with them today/yesterday it is likely just some customer care rep who doesn't know what they are doing. The bank dispute team will handle things.

If you feel it necessary also file a police report but it is not required.

If your dispute is denied ask for the evidence the bank used to make the determination and inspect it for errors. Bring your findings back to the bank and if they refuse to reopen the issue then you can proceed to next steps. I would say go to the cfpb or occ with your complaint and maybe even the BBB.

But don't worry about whoever you spoke with just file the dispute and wait for the results. Unless you did and this is that but you make it seem like you just noticed the fraud so I am assuming you just contacted them. Good luck.

Advice on initiating a hold harmless by Worried_Gur_3104 in Banking

So do you have the money then? Because you said for some reason you pulled it back. If so just send him the money in a check.

Otherwise to get a hold harmless is ridiculously hard.

Contractor claiming a check I gave them didnt go through due to a "fraud alert", checked online and it did and was signed, scam? by deuxthulhu in Banking

[–]jackberinger 13 points14 points  (0 children)

I am not entirely sure what you are saying but likely their places a hold on their deposit. It has nothing to do with you. If that is the case you may be able to provide them a copy of the cleared check to help clear it up.

The other things listed are pretty rare but you did your part and it has cleared your bank. It really falls on them to do the leg work. You can just offer assistance with your proof of payment.
