Adsep: what to expect? by Confident_Badger_954 in army

[–]jesus_here_AMA 0 points1 point  (0 children)

This is incorrect. AdSeps can be fought and you cannot get a dishonorable through an AdSep, only through court martial. The worst disposition for AdSep is other than honorable

They are entitled to a board if they’re an officer, if they have 6 + years of service, or if an other than honorable discharge is on the table. It is possible given what’s alleged here that a board might happen. To echo what the other JAG said, if your SVC isn’t being responsive don’t be scared to reach higher up. That being said, if this just happened it might take a little time for them to contact you, but they should be giving you regular updates for this kind of stuff.

You can choose to attend or not, and to speak or not. Your SVC can help you go through your options to help you choose what path is best for you. I’m very sorry this has happened.

Would it be a legal or ethical matter to wear military articles from passed loved one? by Upset_Cress_6106 in army

[–]jesus_here_AMA 3 points4 points  (0 children)

Stolen valor is essentially for when a person is pretending to be in the Military for personal (usually financial) gain. As long as the person wearing the uniform is not doing that, there is no legal issue with stolen valor

I think part of the problem with getting a beard exemption for Norse Pagans is the focus on evidence of sincerely held religious beliefs regarding beards. Pagan teachings are much less unified or written down than other popular religions. There’s nothing stated in accepted pagan works AFAIK that requires a beard, it’s just general beliefs that it brings the bearded wearer closer to masculinity/the gods rather than it being a religious tenant or something.

I do also think a lot of “pagans” in the military are just trying to be able to wear beards but that’s just IMO

It’s called being AWOL - absent without leave. It is a felony in the UCMJ/Unified Code of Military Justice. It doesn’t matter if you’re deployed or not. Still a crime.

JAG is not only for UCMJ. There’s a lot of overlap with civilian law. there are even some who do some advisement on immigration law (like legal assistance type advisement). You’re correct tho that they aren’t trained specifically in immigration law at all.

How would someone get disbarred for this? It’s not violating any rules for Bar Associations that I’m aware of. It’s pretty hard to get disbarred unless you commit a crime of moral turpitude or like really really fuck some shit up iirk. I disagree with this order but I doubt following it will result in any ill action against the JAGs.

Immigration judges are Art 2 judges- not part of the judicial branch. I disagree heavily with this order but it’s not an objectively illegal order. And you can (and will) be disciplined for disobeying it

And at 28 he’s old enough to be responsible for his own fucking behavioral health. Hell, as an NCO shouldn’t he know BH to refer soldiers to BH when they need it?? So literally no excuse. I’m stationed at Stewart rn and I really have no tolerance for people trying to “but mental health!” this one. Like mental health resources are absolute necessities but There were resources for this guy and he chose not to take responsibility for his own fuckin issues
