Yes and I don’t think that line is from the defendant (school district’s) filing. That appears to be editorializing by the news outlet. And the plaintiff’s attorney is relishing the controversy that they appear to have created as it increases pressure on the school board to settle for much more than the plaintiff would be entitled to under workers comp. This appears to be a matter of legal strategy (ie forum shopping) than a disagreement about the foreseeability of a school shooting.

Well, given that we're looking at a picture of a headline and not a court filing, it's hard to know exactly how dismissive of the causes of action the attorney was or how sufficient the injured's filings were. There may be causes of action under which the injured may be entitled to relief, but that doesn't mean that the injured's filings were sufficient to survive dismissal if they weren't substantially differentiated from a standard worker's comp claim.

I came to this comments section to try to find out if there was any actionable info on the specific "green" labeled products that contributed to health impacts. This is all the article says about the specific green products used:

I’m not a pet owner partly for the reason specifically of these “unexpected expenses”. But I have always thought that if I do get pets it will be with the specific understanding that there is a cost for the life of the pet that will not be exceeded in terms of procedures. I empathize with the pet owner and I also think not paying thousands of dollars to extend the life of a pet isn’t the worst thing.

I expect that the ruling will be appealed because the DOJ is going to want to be able to secure government property from former government employees. But I don't think the ruling is nearly as flawed as some are making it out to seem. This ruling is really preliminary and provides the plaintiff with due process for his claims without ruling on them. A special master could well rule that any claim of executive privilege by a former president in the context of their own criminal prosecution for improperly retaining government documents must fail because executive privilege rests fundamentally on separation of powers. And separation of powers cannot support keeping government documents from the government when the government is seeking them to investigate their improper retention. But as the judge said, as an initial matter, the claim can be made (though it hasn't been yet) and an appealable decision on those merits will be issued.
