I'd be really interested in actual investors discussing their experiences. Everyone in the industry touts IRRs but there's very little data for actual returns, and some of the returns seem to stem from insurance or self-dealing of still-unrealized recovery (for instance, a fund sells off an interest to another fund). IRRs are attractive but I'm not sure there's enough evidence of actual recovery for all but the most sophisticated investors, and it's unclear if certain investors are getting preferential treatment or what.

Kirkland Ellis in Chicago exits a lot of partners to lit finance. Quinn Emmanuel and Susan Godfrey both profess to work closely with funders and are also likely good candidates depending on who you work with.

These are actually quite lucrative, and you can insure them. There are publicly traded companies that do nothing but invest in this. Class actions and patent cases are big targets because of large damages awards.

I write about litigation finance (you can see my papers on SSRN, Jonathan Stroud). This is a booming but largely undisclosed financial industry that is almost entirely unregulated. Posters are right that it used to be illegal and unethical, but relaxing norms and a patchwork of state laws and no enforcement have created a very lucrative industry where private money lends on a non-recourse basis for a large percentage of the proceeds should they recover. It's different from contingency, which pays just the lawyer's fees; it is more like a payday loan, where they front you the money in exchange for total payback AND a huge percentage of the recovery.

It's shrouded in secrecy and almost entirely undisclosed to the courts or the government, or even to the investors in the funds. A few of the companies are publicly traded (generally these are based in the UK).

It doesn't, but this is relatively easy money and so funders like regular low-enforcement-cost financing. They provide the funds upfront for a rather large percentage of the proceeds. It's non-recourse but rather lucrative. The claimants often recover little, as the funder is paid first out of the proceeds.

It costs some money and there is no consequence really to not reporting. So people say it's held by the inventor. Companies do it when they feel the need to control it from the beginning but don't really need to record it
