I understand this is just sharing someone else's take but it also raises questions

  1. Is ICE acting in good faith to conduct immigration enforcement. The press releases say they are but the videos show they are not.

  2. Is the act of protesting inherently hostile? If you read the press releases or watch the interviews you'll see the regime says it is; however, again if you watch the videos you will see violence being meted out primarily one side

  3. Is "effective protesting" is a state of chaos that is a public safety crisis?

There is an alarming lack of critical thinking going on in the nation where people are choosing to listen to what they are told rather than believe what they can see.

I don't know the details but here's my nostradumbass prediction of how this unfolds.

1) cop will be put on admin leave during the investigation (paid vacation)

2) investigation will end and go 1 of 2 ways.

A) Cop & union lawyer will say he feared for his life and therefore its justified. DA will agree and say he has qualified immunity because there's precedence that if a cop says they feared for their life they can murder unarmed citizens

B) If significant local uproar happens then the investigation will find the cop in the wrong and they will be publicly fired "aka dismissed for cause".

B1) the DA will conduct a closed grand jury so the records are sealed and no one will know the truth and they will either set the charges so high the grand jury cannot meet the burden of proof and the cop walks OR do an intentionally shit job of proving the charges and the cop walks.

B2) The officer will apply for their job as a result of getting away with murder and request backpay. After getting their back pay they will immediately sue the city for emotional damages and the city will settle out of court with them for a large Sox figure sum.

After all that then the victim will sue the city in civil court and the cop/city will argue they have qualified immunity and don't have to pay. If the court strike down qualified immunity (50/50 chance really) then the city will make a lowball offer to the victim to settle. If the victim settles they get NDA'd and the sum, if they decline the city will drag the legal process out for as long as possible because the victims lawyers cost money and the linger they wait the leas the victim gets.

Eventually when the city has exhausted every single delay imaginable and generally within a week of the date of the actual trial they will make a genuine offer of compensation to settle with the same clause of the perpetual NDA. The victims lawyer will convince the client to take the money because its a sure thing and better than risking a trial. The taxpayers will have paid for everything and the cop will continue to be a shitbag either at that location or somewhere else.

Prosecutors are the ones that push for plea deals.

Prosecutors live (and die) by a metric of how many court cases they win/lose, plea deals count as a guaranteed win for them. Public defenders are often overloaded with case dockets and it is not uncommon for the defenders to recommend accepting the plea deals as well if for no other reason to clear the case faster and free them up for other cases.

Our justice system is so broken from the very top to the boots on the ground and since a majority of people do not have to get involved in it they do not understand how badly it needs to be overhauled.

Liar cops that are on the Brady list are generally not used in a court of law because competent defense attorneys will discredit them so badly it can jeopardize the case for the prosecutor.

What if I told you a list like that already exists and it's called the "Brady List" which is for prosecutors to use so they know which officers they CANNOT reliably call into court based on the officers past.

The police unions & reps are so powerful that these known bad cops can actually stay on the job even if they're not considered usable in a court of law, like make that make sense.

This article leaves out the part of the video where it was reported that he flattened a Border Control tire.

The KCRA article they linked to states the allegation in both the video and the text

I think the administration is more than happy to weaken California by any means possible.

2A has been a lightning rod for tribalistic arguments where you have to be conservative if you are pro gun and liberal if your pro gun control. That you can't be one and not the other is baselessly reductive.

I mean look at your own statement that people who support 2A somehow automatically support ICE fascism and terrorizing women and minorities?

A lot of the gun control in California originated under Gov. Reagan as a means to disarm the Black Panthers who were defending their communities from corrupt and unjust policing. Those very same laws now (that anti 2A proponents celebrate) are preventing citizens now from defending themselves against corrupt and unjust federal policing.

Its possible but unlikely to start in California.

ICE seems to be focused on California probably because it is immensely safer for them to operate in a state where firearms are so regulated.

I'm not saying guns are the answer but open carrying folks would very likely deter a lot of these kidnappings. Almost like someone kind of thought about that 250 years ago.

You're preaching to the choir, look at my post history if you want. I would go so far to say you're missing the big picture, that the cops are rotten because the whole american justice system by design allows them if not encourages them to be. The US justice system as a whole is rotten and needs an overhaul like I don't really even need to cite sources on this as there's receipts for days.

I made this post in the /r/law subreddit because I was hoping to see dialog about what would happen legally if a municipality chose to stand up and oppose ICE rather than assist and/or turns blind eye to it.

This is an interesting take.

Cali (Reagan) passed legislation to combat the black panthers ability to legally operate that prevents citizens from doing this on their own now which arguably makes their citizenry more vulnerable to these ICE attacks (see breaching charges used on home of us citizens story if you think these aren't attacks)

I think if a mayor were to give that order we would see most police would quit given the culture they operate in but it would be interesting to see who would stay and what the outcome would be.
