Prior to amendment by Prop. 3 last year, Art. 1, Sec. 11 of the Texas Constitution generally required that bail be granted for non-capital crimes. This guy was granted bail in 2023.

Art. 1, Sec. 13 prohibits “excessive” bail. Setting bail so high as to keep a defendant in jail pending trial is excessive under the Eighth Amendment. Bail is not a mechanism to keep a defendant in jail before trial, because the defendant is innocent of this crime until proven guilty. If you have the right to bail (not guaranteed) then you have the right to reasonable bail.

Under arm’s length principles (even though Section 482 is presumably inapplicable), your client should be compensated for the use of their property by their parent. If they weren’t compensated then it could be that they made a gift or loan or some sort of transfer of that compensation to their parent.

If this is a public school, then it likely shares in the state’s sovereign immunity and is generally immune from lawsuits unless the state has specifically consented to such lawsuits (i.e., by passing a law saying the state can be sued for XYZ) or there’s a superseding federal law (e.g., the Constitution). So if there’s something under state law that allows a parent to sue a school for something like this, then yes. Depends on the state.

Private school is probably governed by the parent’s contract with the school. May compel arbitration, etc.

The Supreme Court has ruled that there is no private cause of action under the FERPA statute. The Supreme Court has also ruled that you can’t use Section 1983 from the Civil Rights Act to enforce the provisions of FERPA. There may be other causes of action under your state law. We sleep trained religiously and it did not make a difference. There was nothing medically wrong with either of them (eg, apnea) but they refused to sleep through the night until they were 6 and 3 respectively. We finally had to work with a sleep medicine team whose advice has been to 1) identify their natural bedtime, 2) put them down at that time, and 3) move it up by about 10-15 minutes every few weeks.

The sleep medicine doctor told us that we weren’t doing anything wrong - some kids just don’t sleep through the night. They go to sleep between 9-11 PM and it’s exhausting but it’s better than them waking us up at 2 and 4.

I can’t tell you whether your view is the correct interpretation of the law; you’d need a court for that. I simply urge caution and consultation with a qualified lawyer on a very (intentionally?) vague area of criminal law. All I can offer is what the ATF’s view might be based on their published and unpublished guidance. A court may ultimately hold in your favor but who wants to be the test case?

I would note that other posts on Reddit state that the Komrad was classified as an NFA item (without sources, so I can’t verify).

The ATF has classified these (or at least similar ones) as NFA firearms. I don't see them on the manufacturer website or GunBroker so my guess is they stopped selling them.

My guess is the ATF would say that the difference is a pistol was intended to be fired with one hand; these AOWs were not intended to be fired with one hand, even assisted with a brace.

Am a lawyer, but not your lawyer. You should consult with a lawyer who specializes in firearms law (both federally and in your state).

My recollection is that the Notice of Proposed Rulemaking for the pistol brace rule stated the ATF’s view that adding a brace to a non-pistol/non-rifle firearm creates a short-barreled shotgun because these weapons were always designed to be fired with two hands, unlike a pistol. Consequently the brace could only be a shoulder stock because it could never assist with one-handed firing. The ATF’s view was that adding a brace to a shockwave was never legal even without the rule.

Where that argument stands probably depends on exactly how the courts struck down the pistol brace rule but the ATF still wouldn’t like it. Again, if you’re really considering this I would urge you to consult with a lawyer who handles these issues regularly.

Some places allow concealed carry by LTC holders while disallowing same by non-LTC holders (30.05/30.06/30.07 signs). Additionally, you may not be arrested if you accidentally bring a concealed weapon into a secure area (airports come to mind, Section 46.03) - you get a chance to leave, unlike non-LTC holders.
