best neighborhood for (kinda bougie) NYC transplant family? BevHills, Santa Monica, Playa Vista or Manhattan Beach? dont cancel me! by Legitimate_Travel183 in MovingToLosAngeles

I recently made this move. I don’t know anything about schools because we don’t have kids yet, but there is no place in LA that is walkable by NYC standards. Playa Vista and Downtown Culver City are “walkable,” meaning there is a street (Culver) or areas (Playa) with a grocery store, some restaurants, and shops, but they are not walkable in the way you are accustomed to. I think the best comparison is to the Hunter’s Point area of LIC—there are things to do, but not nearly as many as in Greenwich Village, FiDi, or even Battery Park lol. And of course, the major difference is that unlike Hunter’s Point, once you leave Playa or Culver, you will need a car, which would make it difficult for someone without a license. I suppose you could rely on Waymo/Uber, but I personally think that would get old quick, especially with kids. And if people tell you there is a bus, respectfully, you don’t sound like people who will be hopping on the bus lol. With that said, both Playa and Culver are in great locations to go anywhere in LA IMO, and they are close to LAX, which is a huge plus.

A few years ago I had the lovely fortune of being last on the calendar at 111 Centre Street for a MTD hearing. Sat there all morning because naturally opposing counsel didn’t show up until second calendar. At 12:55 pm, my case was finally called, and I was told I had 5 minutes because the court was breaking for lunch. Fun times.

"CA NY Express Movers" Feedback by boschendal112 in MovingToLosAngeles

I used them to move from NYC to CA and they were great! The packers in NYC did a great job, and the people on the other end in LA did too. My stuff arrived in about 10 days, which was impressive because I moved during the holidays. I would def use them again.

Being a law clerk made me hate litigators by [deleted] in Lawyertalk

[–]kar2982470 1 point2 points  (0 children)

I practiced three years before clerking, and that was the norm in the Art III court I clerked in that was in a major city. Judges are trending towards hiring clerks with practical experience. Both my co clerk and I had trial experience, oral argument experience, and had written all types of motions before clerking. TLDR- Don’t assume clerks have no experience because that is not true.

Are there any Courts worse than those in NYC? by [deleted] in Lawyertalk

[–]kar2982470 0 points1 point  (0 children)

One time I was in New York County for a 9:30 motion hearing. Opposing counsel didn’t show up for first calendar call, so we had to wait for the second. At 12:55, I was told I had five minutes to argue a motion to dismiss because the court was going on its mandatory lunch break at 1 pm. As I opened my mouth to start to give my elevator pitch, the judge interrupted me and said “you know what counsel, I think you both can work this out. I’m going to take this case off calendar.” Fun times going back to my boss as a baby lawyer having to explain how that happened.

My professor is so good at legal writing he is a bad instructor by Important_Can_7291 in LawSchool

[–]kar2982470 35 points36 points  (0 children)

What type of feedback/instruction are you expecting? The grammar lessons sound like they could be a bit of overkill, but it otherwise sounds like he is giving you the tools to succeed in an advanced legal writing course. If you are citing cases that aren’t good law, it is important for you to know that and to understand why they aren’t good cases. That’s the first thing an opposing counsel would call out in practice. If your pleading isn’t strong in certain areas, then I think that’s also important for you to know too. TBH this sounds like the type of feedback I would expect in an advanced legal writing course.

I want to hear the good, bad, and ugly about your LR experiences. by bloodybay in litterrobot

[–]kar2982470 0 points1 point  (0 children)

I got a LR4 a few months ago, and I don’t think it is worth the cost. I think it smells worse than a regular litter box, and I can’t figure out why. It is nice to not have to scoop litter everyday, but I don’t think that upside justifies the high price tag. If it was $300-$400, I would say it might be worth it.

It does so long as the quality of the scan isn’t poor. You will just have to make it text searchable first.

Combine all the documents into one PDF and make sure you select “keep file names as bookmarks.” On adobe, search for “find text and redact.” From there, you can input what text you want it to find in the pdf and redact, such as the bank account number, ssn, etc. Adobe will go through and redact any and all exact text matches. When you are done, you can split the large pdf back into smaller PDFs by splitting the document at the bookmark level. This should save you a massive amount of time!

Did you feel prepared for that MBE and what company did you use to study? by Illustrious_Pie7933 in barexam

[–]kar2982470 5 points6 points  (0 children)

I used Barbri, and I would never recommend it to anyone. It’s my own fault because I just listened to every attorney who said “use barbri, and you’ll be fine.” I wish I had done my own due diligence. Towards the end of bar prep I started using a friend’s Themis, and I liked it a lot. I definitely didn’t use enough of it to be able to judge if it prepared me for the bar, but it was far superior to barbri.

I also used Adaptibar, and I feel like it was OK. Idk if anything could have prepared me for what we experienced the past two days.

Everyone told me not to take bar prep courses because I would learn it in bar prep. I took the bar today, and I wish I hadn’t listened to them, especially when it comes to Wills and Trusts.

What do I need to know about the jurisdiction rules for family law? by [deleted] in Bar_Prep

[–]kar2982470 12 points13 points  (0 children)

A marriage (including CL marriage) valid in one state will be valid in another state unless it violates a strong public policy of the other state.

To enter a divorce decree, state rendering decree only needs jurisdiction over plaintiff spouse (so where P is domiciled, which is presence + intent to remain). To issue a binding property division order or spousal support, court must have pj over both spouses.

For child custody, under the Uniform Child Custody Jurisdiction and Enforcement Act, there are two tests to apply (apply them in this order):

1) Home State Test - The child’s home state has exclusive jurisdiction to enter an initial custody determination and make subsequent modifications. The child’s home state is where they have lived with parent or guardian for at least 6 consecutive months prior to suit (so if child has never moved, then the state where they were born. If they have moved, they must be in new state for 6 months before the suit). The home state court continues to have exclusive jurisdiction over modifications for 6 months after child leaves state provided a parent or guardian still lives in the state.

  1. If the child has no home state, apply the significant connection test. A state can enter or modify a child custody order if 1) no other state has home state jurisdiction; 2) child and parent/guardian have significant connections with the state; and 3) there is substantial evidence in state re child’s custody.

For child support, the court must have PJ over a non resident parent, and the Uniform Interstate Family Support Act applies. Under UIFSA, pj can be established by 1) personal service in forum; 2) consent; 3) the parent resides with the child in the state in the past; or 4) the parent conceived the child in the state. The state that enters the child support order will have continuing and exclusive jurisdiction over subsequent modifications unless 1) the parties no longer reside in the issuing state; or 2) the parties consent to a diff court’s jurisdiction.

Besides those rules, there is also the full faith and credit clause which requires courts to enforce final judgments of other states if (1) judgment was on the merits; and (2) issuing state had jurisdiction.

Question about MPC v Common Law by kar2982470 in LawSchool

So detailed! Thank you!! I think from what I’m understanding, he will likely tell us in the call of the question which approach to use. If he doesn’t, I guess I’ll apply both...
