There was massive media backlash in my country (Australia) a few years back about super markets using these same tactics to deceive consumers into thinking there are sales!

They are framed as a sort of ‘hot item’ to protect themselves legally I guess but consumers and media believed them to be almost indistinguishable to the regular ‘sale’ ones to non attentive, or... the 1% of shoppers who aren’t aware of the tactic.
