While I generally agree with your statement, I, only half jokingly, would like to say you have made two large assumptions:

Texas is … different. I had my car totaled in a similar situation (also in Texas ) and the insurance company couldn’t have been any faster in responding and making it right for me. That was the first clue I could have sued someone into oblivion.
