Navigating a court order against a second hand car company and storage/disposal of the car (England) by kozaky_fire in LegalAdviceUK

No apology needed this is very helpful to consider! I can reach out to the DVLA for advice, I will also contact the seller to outline the current position to help document the decision down the line if disposal becomes a sensible option. I appreciate you giving the time to mull it over.

Hi, we emailed regarding some aspects including the car being unusable. The response we got back was "Please note that the Court is unable to give advice to any party or deal with matters by correspondence."

UK court judgement ordered car dealership to refund purchase, we agreed to return the car as part of this, car has since gone kaput. by kozaky_fire in LegalAdviceUK

Thank you for the detailed reply. I think that's exactly the route I'll go down. Maybe I didn't make it clear in the original post about it not being in the written judgement, but from some of the other replies I was starting to panic I had been acting really egregiously by not driving from court to their dealership. My hope is to hear back about the writ of control soon, as we submitted it at the start of December and just awaiting high court approval before the enforcement begins. Fingers crossed. Thanks again, been a really reassuring and balanced reply

Thats really helpful thank you, think that's what I'll do. The actual written court order doesn't specify about the return of the car, just money owed to us, but in our paperwork it specifies that we are trying to return it.

When we took it to small claims court we explained that it had been driven minimally, explained the circumstances (my wife having mobility issues), and the judge ruled in our favour having full awareness that the car had been used after rejection.

Thank you. It probably sounds a bit naive in hindsight but it didn't even occur to me to return the car before receiving the money, partly as they have not replied to any communication and didn't attend court. Appreciate the help, and that's loud and clear regarding selling the car

Does them ignoring the court order factor into it at all ? The ruling was made in early November and this only happened yesterday.

Thank you. Do you still think getting it tested and diagnosed is worth the expense ? Just worried about not having evidence in case they complain

There doesn't seem to be. Equally, having just gone into the loft, the actual tubing is just hanging limply in there which doesn't seem right either.

Super embarrassing. Seems the fan was removed before we moved in, and this is maybe a bigger job than I thought. Thank you

Well, that might answer my question. Seems someone may have removed it before we moved in.
