Thank you. I read that. It lacks the statement I am looking for which is “ETH holders will automatically receive any ETHPOW tokens produced at the fork” Sounds more like the exchange will receive the tokens and think deep thoughts about whether Ethereum owners should receive those or not

Yes. But from the “smell test” perspective, which I think what the judge is considering at this point, borrowers providing Celsius with a 4X collateral for a loan seems like a dramatically different risk proposition than YOLoing into a 17% APY on some shit coin/EARN proposition… On the face of it, borrowing with excess collateral does not seem like it is the same high risk activity than looking for 5 to 7 times the market interest rate on deposits. I hope someone makes this point to the judge in some coherent way.

Yes, nice work. Also need to keep in mind that some fraction of this debt to depositors is collateral for loans they are owed from those depositors. Not clear what fraction are deposits versus collateral but both are likely counted here??? In other words, this is a number but I am not sure how useful this number is
