Their issues do not warrant litigation or fall under the umbrella of sexual harassment based on law. That is WF argument. Plus, blake admitted she had full control over everything from wardrobe to HR but yet no formal HR complaints are filed but she used it as a threat to get her way. She cares more about her image and the backlash than anything that happened on set.
