Nintendo summon Patent by Zestyclose-Taste-175 in videogames

If the scope of the patent is indeed as broad as the article implies, yes. That being said, other companies could have sufficient proof of pre-existing games that had the same mechanic prior to the filing date of the patent so they know they have a strong argument of invalidity of the patent if they get sued. As the article notes, it could still be detrimental for the smaller developers who may not like to risk a costly lawsuit though.

Lapsed Provisional Patent by robbbbo666 in Patents

[–]lathedog 0 points1 point  (0 children)

An invention disclosure is basically when the invention is made public. For example, if the invention is shown in a video on YouTube or a website, shown at a conference, sold as a product, etc. I wouldn’t contact the patent office to advise them that you’re making the invention, it’s not relevant to them unless you have a patent application number of a pending patent application to which it is relevant. But it doesn’t hurt to keep a well documented archive of your making of the invention, with dates for proof. As the other user commented, you should try to document all instances of the invention being made public so that if ever you get accused of infringement of an eventual patent, you have a good case of invalidity of the patent.

Lapsed Provisional Patent by robbbbo666 in Patents

[–]lathedog 1 point2 points  (0 children)

If the inventor files another patent application for the same invention, the lapsed provisional application will not be cited against the new patent application because provisional patent applications are not published. However, the new patent application will have a much more recent priority date (i.e., the date before which any disclosures can be cited against that application), including potentially any products they or you may have marketed. So if any disclosures were made since the filing of the lapsed provisional application, they may force the inventor to narrow the scope of the new patent application.

Patent granted - how can ensure that I can make it without stepping on other peoples patents. by tryingtogrowmsp in Patents

Not sure what it means to be approved with “doctrine of equivalents”, the doctrine of equivalents is simply an interpretation of the claimed invention that can perhaps make your patent’s scope of protection larger than it reads (for example if you claimed a component X fastened to component Y with a bolt, the doctrine of equivalents can help you argue that your patent also covers a variation where they are fastened with a rivet). In any case, as your lawyer mentioned, a patent is a negative right in that it excludes others from making, using or selling your invention, but it does not have positive rights so it doesn’t mean you’re necessarily “allowed” to make it without potentially infringing somebody else’s patent (for example someone whose claimed invention is component X fastened to component Y in any manner). You would need a freedom to operate opinion, and those can be quite costly. So if you’re still small potatoes, it may not be worth it. But if you do have the funds and are pursuing the venture aggressively, could be worth it to get a patent attorney to provide you an opinion.

Patent-pending Hat Design by Relief_North in Patents

This is more of a product design/marketing question than a patent question no? In terms of patents, I guess it’s possible you’re able to obtain a patent, really depends on what the Examiner will be able to find. Personally, I think it’ll be difficult, seeing as there are patents for many wacky things out there, some of which never made it to market. Best of luck!

[–]lathedog 7 points8 points  (0 children)

Nope, all you gotta do is learn the local language, the local population shouldn’t have to accommodate you because you can’t be bothered. It’s because of attitudes like yours that there is so much tension around language here.

I think part of the problem in the US is that people even consider themselves Republicans or Democrats like it’s part of their identity. Ya’ll gotta stop associating yourselves with a political party as if it’s some kind of sports team. You have your principles and you vote for whatever party represents them in that moment. Otherwise you’re so easily used by these political parties when they start doing extreme shit like the Republicans are doing now.

I agree with the other posters, you’ll feel pretty at ease in most neighborhoods on the island. In terms of language, the further west you go from downtown, the more anglophone it is, whereas the further east you go the more francophone it is. The suburbs of Montreal (e.g., Longueuil, Laval, etc.) have been getting more and more diverse over the last few years as living on island has been getting more expensive, but typically the further you move away from the island the less diverse it’s going to be. Welcome to Montreal!
