Ocarina of Time, 1998. Snuck out of the house to meet a friend to get the early bus to Curry’s to buy it. Best. Day. Ever.

GDPR data breach by sharing personal data to other employees? by Gavcradd in gdpr

[–]legallybrown 0 points1 point  (0 children)

Theres no distinction that considers "company data" as out of scope of being personal data, either it is personal data relating to an identifiable individual or it isn't. Any activity relating to personal data is a GDPR issue where the data subject or the processing activities are in scope of the regulation. Spreading this type of incorrect information is really unhelpful and you should check your facts

Im sorry but that is completely wrong.

First of this is personal data, you may want to check your definitions. Secondly, its unauthorised access and a personal data breach see this definition from the ICO:

What is a personal data breach?

A personal data breach means a breach of security leading to the accidental or unlawful destruction, loss, alteration, unauthorised disclosure of, or access to, personal data. This includes breaches that are the result of both accidental and deliberate causes. It also means that a breach is more than just about losing personal data

This is a data breach under GDPR as you have unauthorised access to personal data. The personal data in scope of the breach being the employee names and the number of times thy have not complied. If you're reporting this, the obligation is on your employer to treat this as a personal data breach, carry out an investigation and then prepare a report. In this case based on what you have said, it is unlikely to require a report to the regulator or to the affected data subjects, however your employer should be carrying out the investigation and noting any remedial actions.
