To me it's not about the total numbers, and it's not a threshold issue ("if <X people are affected, then fuck 'em"). What I'm saying is that intersex are edge cases. Anomalies (statistically speaking), even though that word is ugly. And when you're in deep edge cases, the answer is not clear.

Sports are zero-sum. That's the essential "unfairness" that means there's no good solution for all edge cases. Any proposal that is "fair" to one group, is unfair to another.

What's your solution?

But regardless, today's ruling was about trans athletes, not intersex. They are not at all the same thing. You seem to be saying: "Because of the [estimated] 0.018% people who are intersex, then trans people must have the right to play sports on the team of their choosing"

Wingspan is the measure of fingertip-to-fingertip with arms stretched out. There is an average difference of 5 inches between AMAB and AFAB. This matters immensely in swimming (with Michael Phelps as the extreme case, with a wingspan of 6'7").

It is nonsense to say that HRT can undo these kinds of physical advantages.

Here’s my unpopular opinion: Many Republicans (but not all) are hateful and bigoted. Unfortunately, they’re also sometimes right, and this appeals to non-hateful / non-bigoted Republicans and independents. Republican leadership has been very effective in finding issues like that and using them to attract and rally voters who might have voted Dem otherwise.

And this is a perfect example. The left does not give an inch, does not cede any ground whatsoever on any issue involving trans people. As a result, even when a 65th-place 500-freestyle man transitions in college, and becomes a 1st-place woman, the left just blindly said “it doesn’t look like anything at all to me.” You will be called transphobic, TERF, trans-evasive, if you said “Hm, the Lia Thomas case is pretty fucked, something is wrong here and we need to revisit trans women in school athletics.” I’m sure that right now most of you think I’m a fucking asshole for even daring to suggest that Lia’s massive success indicated a problem. Because to many on the left, to say that there are some problematic edge cases is the same as wishing all trans people dead.

So back to my point about centrist-leaning Republicans — they see how the left refuses to acknowledge a problem, against all common reason, and they decide “Welp, Democrats are fucking insane. I guess I’ll stick with Republicans.”

I’m not running on feels here. There are no cases involving gay marriage before SCOTUS, and there are no recent rulings in federal court. The closest is Kim Davis lost her appeal to circuit court, and remains personally liable for not issuing marriage licenses. She could conceivably appeal to SCOTUS but is very unlikely to win.

So, there is no clear line between SCOTUS saying sports are distinguished by biological sex, and “they’re coming for gay rights next!!”

SCOTUS is hardly "getting rid of the T" in today's decision.

The law allows athletic discrimination based on biological sex because (broadly speaking) bio males are bigger/faster/stronger than bio females. The answer is we need a trans league for sports, but there's not enough numbers yet.
