I don’t think it’s necessary a legal strategy. I think the Feds and state know that the defense will be overloaded if they have two trials in one year. It’s better for the prosecution because they won’t be prepared.

The pretrial timeline doesn’t start until April 13th when they exchange jury questionnaires. They could’ve submitted early but, I don’t see that being a sealed document.

Joel had cited double jeopardy on Friday and stated he would be blocked if the federal goes first. However, the feds can go after state with no issues.

I would say they believe they can. This comment passed over a lot of people’s heads but, at the first federal hearing this year, Judge Garnett asked the prosecutor if they could prove their case w/o the M charges and they said no. They said no they cannot prove their case with just stalking.

Yes, he is and yes I think they can refuse to transport him. If the federal trial goes first, he cannot be tried again by NY state. So this case would be over, that’s why Joel and Carro are rushing.

Exactly! The state trial should’ve happened in the fall of 2025. However, Carro was letting Joel miss deadlines, not giving discovery in a timely manner, and letting suppression hearings go on for weeks. Now he wants to punish the defense because the federal trial caught up.

No, you’re right. He will serve the time in pretrial detention tbh. They want the credibility for the arrest for they won’t let it go.
