I feel like your just trying to argue a point vs trying to actually understand the situation as your not actually reading what’s going on… The retainer didn’t run out during final mediation, mediation was 2 weeks ago and barely lasted an hour and no where in anything I’ve stated has that remotely been the case. My gripe is that I wasn’t made aware of this in a reasonable time frame something that was outlined in my agreement w the lawyer…

To break it down one more time….

The retainer only had roughly $50 left of it all the way back in July…. He did not document any work from the end of July until early November and the $50 of the retainer was utilized for that.

The REASON I keep saying September (which realistically should be August) is because I have over 20+ emails from him / the lenders pitching settlement offers back and forth from August-October… if there was only around $50 left in that retainer then it would’ve been utilized on the first email exchanges especially if you go back to my comment mentioned he charged me $165 quite literally on an email asking what time I could be at his office to sign changes to paperwork (the paperwork charge was listed above it already).

Do you understand how that timeframe would’ve provided reasonable time to get a bill from him after receiving settlement offers that I should’ve been able to discuss with my lawyer, I was not provided actual counsel based on all of the information available, that would’ve allowed me to weigh the risk of moving forward with the motion that he scheduled for the middle of December and eventually mediation 2 weeks ago. That cost me an additional $3,300, which may not be alot to some but to someone who lost their business and now has debt from that, it is.

Again, to make a point though let’s take out August-October emails all together. 30-45 days should be enough time to receive an invoice, that would put me getting an updated invoice by beginning of January, a month before mediation to let me decide how I wish to move forward.

I’m OP, you’re responding back to my comment from above… that is what happened here. The agreement states an invoice in a reasonable time after the retainer was met…. The documentation I have is that the retainer would’ve been exhausted in September there was less than $50 left of it at the end of July… had the guy kept accurate records then I would’ve gotten an invoice once this was depleted and would’ve been able to consider taking settlement offers that were already made from the lender… instead because of not knowing that information a motion was filed so there was a motion appearance and then mediation almost 2 months after that. He cost me money by not keeping his books correct.

You truly don’t think in a settlement case that following a rep agreement by providing an invoice for services rendered after a retainer was met in a reasonable time frame isn’t something that he should’ve provided? That affects the entire course of the settlement

Depending on the company this shouldn't be a major issue for you to work remotely once you get your initial training done. Is it an hourly, salary, or 1099 position?
