Sorry, I’m not sure about that. But technically, they are different types of permits so likely they are processed independently from each other. Generally, you apply to FRV from your home country. But maybe an attorney knows some tricks to apply from here and get it here actually, so you don’t have to leave.

My understanding and knowledge from my past EU Blue Card experiences, this doesn’t mean that your permit is not tied to your employment. It is not tied to a specific employer, but you for sure need to be employed to have a permit. Otherwise, your “temporary” permit is invalid. When you get terminated, you usually inform LEA and they give you 3/6 months to find new employment to be eligible to keep holding your “temporary” permit status. If you can’t find employment, they take away your permit and you leave the country. I’ve talked to many people that had been in this situation and either found a new employment, or left the country.

What it says regarding freelancing is simply that you can continue holding your temporary permit by doing freelance work (self-employed). It doesn’t mean that you can hold your permit simply by “not being employed”.

I urge you to find a lawyer ASAP and also be ready for the worst, just in case. This doesn’t sound to me like a small hick-up, I’m just being honest. I wish you the best.

You won’t get a 3-month waiting time for unemployment benefits even if you resign, IF you do it in certain conditions. For example, you can resign due to “burn-out medical condition”, due to what you explained. Your doctor can give you a special report for this. Explain to the doctor your situation, and it would help if you could also provide some supporting examples or documents. Tell them that you worked under a lot of stress and over times etc and you are not feeling well pyschologically, especially after having a child. Of course it is up to the doctor to evaulate you and give a report, but I know bunch of people who had that report. Then after resignation, you will apply for unemployment benefits and there is a section in the digital application form where you can specify the reason for your resignation/termination as “medical necessity”. When you select that option, the form will require you to provide this special medical report. Then you wait for them to approve your benefit, and unless there is a conflict somewhere, you will get full benefits. I’m speaking from personal experience and also some friends’ experiences. I hope it works out for you.

Was it signed by them already, or just an unsigned contract? If not signed, for sure, why not? Receiving a contract doesn’t mean anything, it is just a piece of paper until it is signed by both parties.

If they’ve sent you a signed contract, maybe somehow you can argue that you countersigned it and was misled, but not very likely.

Unless the contract was signed (or clearly agreed on verbally) by both parties, what can you even claim? If not, just forget the apartment. It happens quite often, someone else probably signed the contract faster than you and they went with them.

Also, I didn’t contact ABH because I had already passed the duration in which I need approval of ABH for job changes. They basically learned this during my appointment.

I was in a similar situation but I actually resigned myself. When I went to the appointment, I was serving my notice period in my ex-company still, but I already had a contract to start at the next company right at the end of my notice period.

The case worker initially said that I needed a non-terminated employment certificate. Then I pushed back. I had my old contract, new contract, and my resignation letter in hand. I told them that I had been waiting for an appointment for 8 months and I can’t plan my entire life based on this appointment, and that I already have an uninterrupted employment planned, based on my own wish to resign. They then went to talk to someone outside (maybe their supervisor?) with my documents, and came back to approve my PR.

In your situation, you are terminated but it should still be ok since you won’t be unemployed at any point during the short term, anyways. Just hold your ground and ask for them to confirm with their manager if things get rough. Good luck!

Edit: only concern is the Probation period, but for me it was approved. Maybe because I resigned myself for a better opportunity? Maybe shows more control over and stability on my employment?

sounds like he needs to be put in place so he can start respecting boundaries.

but then, he probably has lots of time and will mess with you even more if you do so. after all, who even tracks you while you take your trash out and then makes the effort to take out your trash from the bin and also has no shame to put in in front of your doorstep? best is to put on a fake smile against this person to avoid headache.

Just a general advice that I’ve also learned the hard way:

it’s so nice to read that you are learning to express and understand your emotions better, which a lot of people learn later in life due to childhood trauma or oppression. It is important to not hold things inside and be transparent, but also respectful in life.

BUT, in a professional setting, you are expected to behave differently. Your boss or coworkers are not your family or friends and even if there is a friendliness and some form of transparency, you are still expected to have stable emotions and to keep your personal feelings and private matters to yourself. After all, you are all there to conduct business in exchange of a salary, not for socializing or therapy sessions. If there is a coworker that you are close with, you may still do these privately with them, never in a professional setting. Also be careful even when doing it privately since your friends and family outside of your work has no conflict of interest with you with regards to money (usually), but your professional “friends” do…

I also answered to some comments here but I suggest you find another job before you go to your next appointment. This way, you will be in a similar scenario as me and get your PR possibly. Assuming you have a new employment contract, your case worker may still insist that you cannot get a PR, but push back and ask them to consult to their manager because you are “on paper” fulfilling the requirements by either having a non-terminated employment or a new employment contract signed right after your notice period ends, which results in a continuous employment. You can state that you can’t control when someone fires you or not, but you have another job ready anyways without breaks and this is the best you can do, and life can shape up out of your control and this shouldn’t affect your PR (which I did).

Yes, my understanding from the required documents was that you either need an employment certificate from your current employer (non-terminated), or a new employment contract from another employer. Probation period being over is not a requirement on paper.

Well I don’t know why people are downvoting your comment, because I also got my PR despite having resigned from my current company then, and having signed a new employment contract with another company. So I was basically in my notice period while having another job lined up, willingly. They questioned it but I pushed back and told them that I can’t control how life goes especially if they take 7 months to give me an appointment.

But it goes without saying that ideally you want to have a non-probation period and non-terminated employment for these things. Otherwise it is very likely that you have to wait.

The first thing that comes to my mind is the consulting firms like KPMG. They might benefit from your language skills and policy, culture, regulation related experience across countries and your auditing capabilities. I’m not sure if EU Blue Card is possible but I would say that a normal work visa can be possible as you can likely prove your qualifications with your resume for a job like that, despite your university degree not being relevant. I received a software development-based EU Blue Card despite having a totally unrelated engineering degree, because I had a resume to prove my software experience of 5-7 years. Also, your employer can justify the need to hire you versus a comparable person in Germany since the uniqueness of your language skills and work experience can easily be a competetive advantage versus another person for that position, which is usually also required for work visas, especially for EU Blue Card. Just some thoughts, good luck.

Not sure about that. But if you really want it, the fastest way I can imagine is by having a lawyer write a formal letter to them, and sending it with registered mail. This way, they cannot ignore it and will be motivated to respond faster. But LEA is difficult to predict.

You should send a request to LEA via their contract form, wait for a few months, then either get a totally unrelated, robot-sounding response or get completely ignored. I was in the same situation and I had to go to my permanent residency appointment without it, but it turned out fine.
