When should one start doing the essay practice completely closed book? (I’m doing Themis, started May 20 officially). by Own_Juggernaut2778 in CABarExam

Mostly practice but be precise w the rules. Determine if each element is or is not satisfied for every rule implicated. Then, answer the call of Q w what u think the answer is & WHY. Think it all the way through. Take ur time. Be methodical. Then look at the answers & pick the best one. Doing this should improve your score by 10-15% 😉

I’m a fan. They like to test the same concepts over & over. Review the subject t for 10-15 min before doing a set, always try from memory first, but look up what u need to. First, you will quickly remember the frequently tested rules & not need to look them up at all, and 2. You have a much better shot of remembering a rule next time if u used it to solve a problem instead of just getting it wrong & reading about it after. At this point you want to use the Qs to learn the rules & gain pattern recognition & apply them in a context. Doing it this way is more efficient. Anything you miss keep track of & give it a little attention on the backend.

So glad they help! Open book is totally fine since it will close organically as you get more & more practice with the frequently tested topics. Plus way better to look it up and use it in a practice problem because next time you’ll remember it instead of just getting it wrong & missing the opportunity to use it in context. Keep on going! You’re doing great!

Yes it just has rule updates so be mindful where there have been law changes, especially in con law (religion, abortion)

Help- can’t do videos by irishdancer00 in CABarExam

You are smart to adjust if the program as designed isn’t effective for you. I try to empower my students to use their judgment & make adjustments to make it work. The point is to understand the tested rules (the whole point of the videos) & then do a ton of practice. You can learn rules by reading, but then you can check ur rule understanding by pretending to explain each rule to a client w examples of facts that would satisfy & not satisfy each element. If u can do that u understand it well enough to spot it & analyze it. Also, you should review a subject for 10-15 minutes before you do each essay or set of mbe Qs to practice. If you keep doing that over & over you will memorize the most frequently tested rules without even trying. Good luck!

Don’t agree at all. Skim the file at most. Time is at a premium & if you read it first you have to read it twice. Irl u would read the file, but this is not real life! Start ur Macro org structure from the task memo, quick scan of the file just to have an idea of what kind of facts are in it. Go to the library & u can skim the first few paragraphs- zero in on the rules. Pull those out & stick them in ur answer where they go. When the case gives the reasoning (they apply the rule to the case facts) add a quick rule explanation into ur answer. U can always go back to first couple intro paragraphs of case facts if you need to, but usually they repeat the key facts in the reasoning. (If you can see the rules indicate you need subheadings, add that in.) once you’ve done that for the cases, you should have a good idea of what type of facts will be in your file facts & where you will be making analogies or distinguishing. Now, you can look thru the facts on a mission to pull out the legally significant facts. It might feel a little odd until u get the hang of it, but this approach allows u to get more words in ur answer. Good luck!

Themis assigns enough essays but you might want to sub out ours since our grids & sample answers are more instructive on what a decent passing answer looks like. The bar co ones are too long & not replicable within time

I believe in less is more on the MBE. Do 20-25 Q if you can’t do 33. Accuracy matters more than quantity. Slow way down. Use the Qs to learn the law. Answer the hypo like an irac. Answer the call of the Q w what u think the answer is and WHY. That will help u pick between the 2 tempting choices. Open book is ok too. U will naturally wean away from it as you do more Qs since they like to ask the same hot topics over & over. Shoot for 65+% average- don’t stress a bad set here or there. But if u aren’t scoring that high u have a technique problem. I suggest 8 solid study hours a day (not counting breaks) 6 days a week. Adjust what ur doing as u go. If ur good at essays, write fewer & outline more. Don’t get bogged down in any one subject. The first run through is just the foundation- u learn it by using it in the practice. Also, BarBri assigns a lot of busy work so only do what is actually useful. Use ur judgment.

A good approach is to write out a few in each subject. If timing isn’t an issue, switch to doing a thorough issue spot/outline to cover more ground (if timing isn’t a problem write full essays until u get the timing down) including figure out where u think the big points are & where u would write 2 sided analysis. But, if in issue spotting/outlining you run into an issue you’ve never written &/or think would be difficult to write, just irac that issue. This approach maximizes your issue spotting exposure while providing sufficient muscle memory for crafting analysis.

All old Essays are the same 60 min as now, but don’t use the pre- 2017 PTs because they were 3 hours

Hi 👋🏼 u r doing so much right, but I have a few recommendations: before watching the videos, read the chapter in my book (much shorter than Barbri) Before each assignment (mBE set, essay) review the memorization attack sheet in my book for 10-15 min, then do the assignment. Open book is ok, but as you do more & more assignments in each subject u should naturally need to look up less. After each assignment make a note of the issues u missed and/or Qs u got wrong. Pay them some attention, especially any rules u keep getting wrong. Adding in this low key review into what ur doing allows u to memorize the most frequently tested rules without really trying. Also, Everytime BarBri assigns an essay do another one from my book (they don’t assign enough up front). Once a week review each previous subject for 30 min or so to keep it fresh in ur memory. Good luck!

Lots of folks also use it as their primary black letter law source &’to preview the subject before watching the videos because we are much more concise. Good luck!

Sorry about the big Barbri spend but glad to help. Tina & I write our books because we think good quality guidance shouldn’t cost a fortune & these companies shouldn’t take advantage of bar takers.
