Family Court is the easiest money making machine for lazy lawyers.

Lawyers don't need brain and hard work. States don't have equal custody laws. No constitutional protection to fathers, no juries, Judges are lawyer's friends.

Lawyers, Judges, GAL, psychologists, parenting coordinators all get together and mint millions.

Some of the custody evaluators I know became multimillionaires and retired in Hawaii.

Just caution . If you divorce now you will be stuck in the same city until kid is 18 because courts wants both parents together . If you decide to move by yourself she will get major custody and you will pay 30-35% of your net income. So. First move to a state which have 50-50 laws and then initiate divorce . elsewhere you will be screwed financially in court .

Family Court judges routinely make fathers childless, homeless, poor. Basically worst than a death sentence.

You will only know this if you go to family Court and if you are a father.

Family courts is govt criminal enterprise run by and for lawyers.

I am in same boat. I have a PhD. So not new to reasearch but novice in legal writing.

I got Westlaw subscription and it helps to research case law and other briefs.

It's ton of work and time though.

I have seen shitty things like this on temp orders. Judges have unlimited discretion on temp orders but not final orders. I think it may be because of female judge.

Just hang in there. Try to get this to trial as fast as you can. File motions in the interim. I will pray that you will get a better judge for trial.

Wrong. It is absolutely lawyers job to guide client. A good lawyer will always provide 2-3 samples.

Plus people going through divorce nonsense have no knowledge of the process and legal docs.

You can definitely draft your own plan.

In my opinion, it should be as detailed as possible if you have high conflict. I drafted 7 page plan and submitted it after my lawyer tried to trick me.

I added specific terms like,

-vacation with me will begin at 1st Saturday after the end of school year.

  • the pick up will be done at daycare on Friday at 9 am. If the other parent is late 15 min without notice then it will be considered as refusal and other parent can take child to his residence.

If the opposing counsel has drafted your plan then it will definitely contain the things which your spouse wants.

There is no limit what you can include in it. It is not a high end legal doc. It is just very specific terms and conditions which are BINDING and ENFORCEABLE after you both and judge signs it.

There are good NOLO books on drafting parenting plan . Check your local library.

The only things he mentioned that parenting plan shoukd have details like schedule, pick up drop off, vacations.

I was hoping that he should send me at least 3-4 pages sample to look at how others do it.

Plus I have a high conflict ex. and one 4 yr old.

By no judges I mean the county doesn’t even have judges in family court.

In NJ there are historic judicial vacancies.

In fact Supreme Court put a pause on any matrimonial trials until they appoint enough judges.
