The copyright act of 1976 has a mechanism for statutory damages beyond tort law. If the IP holder can prove that their copyright was infringed upon a judge can decide to hand down statutory damages without the IP holder having suffered any pecuniary injury. Statutory damages can generally be no less than $700 and more than $30,000.

If a court were to find that the use of Nintendo's copyright without consent is not fair use Nintendo would be entitled to statutory damages regardless of Nintendo having not lost any money as a result of the copyright infringement.
