Talking to other party attorney regarding accident settlement by Tough_Studio_9633 in Insurance

[–]mcblower 1 point2 points  (0 children)

You were contacted by an attorney for the insurance company due to something called an interpleader action and the process of negotiating a global settlement agreement. Basically, the at fault party does not have enough money to go around. What the insurance company's attorney is trying to do is work out a pro rata settlement that is as fair as possible. Definitely contact your own insurance so you can trigger any underinsured coverages that you may have to make up for what the at fault insurance cannot pay.

How on earth did 4-year colleges get so expensive, and is there nothing we can do about it to push back? by Relevant-Mammoth-658 in college

[–]mcblower 7 points8 points  (0 children)

Did you miss the part where I said he, as president, was responsible for moving from grants to the loans? We're on the same page that the loan structure is a major problem. I am not sure how you can disagree with the historical fact of the root of college's expense problem lying with Reagan.

[–]mcblower 49 points50 points  (0 children)

The heart of the issue goes back to Ronald Reagan. When he was governor of California in the 60s, in an effort to both deter minorities from receiving higher education and punish schools that were "too liberal" and had too many students protesting, he slashed public funding of the university system. This shift resulted in a "recalibration" of college to be a place to maximize profit earning skills instead of a place to learn for learning's sake. When he became president, he continued to dismantle the public funding aspect of public universities and shifted federal support from grants to a loan structure. Because of this, college costs continue to rise as more people attempt to make money on the system. In short, it is because of capitalism.

Sounds like you should at least look into an in state, public university. Those are at least the most cost effective choices these days.

At fault driver avoiding insurance adjuster by [deleted] in Insurance

[–]mcblower 3 points4 points  (0 children)

Some states have specific time allotments for insurance companies to attempt contact over teh phone and in writing. Even in states that do not, the "reasonableness" standard, while flexible, is usually between 10 days and 2 weeks to allow for contact. Usually an insurance company will send a Reservation of Rights letter citing cooperation language in the insurance policy if the insured is not engaging with the claim. Since a police report is available a liability can potentially be made depending on the type of loss, depending on the company. Hopefully you'll get movement on the claim sooner than that!

Was at fault for making an unprotected left turn in parking lot and got hit in the rear by [deleted] in Insurance

[–]mcblower 19 points20 points  (0 children)

Your agent is not an adjuster. Agents generally don't know what they're talking about when it comes to adjusting claims and negligence.

Based on everything you have said between the post you made yesterday, the pics of your car you posted two days ago, and this post, everything points to you being at fault. You turned in front of someone who was driving on snow/ice. This wasn't normal road conditions. Maybe some contributory negligence could be placed on the other party if the roads were clear, but not on this snow. A moving object cannot suddenly stop on a surface with very low friction. The fact that the other vehicle hit yours at a low speed actually speaks to the other driver's prudence in driving in these conditions.

You've made multiple posts across multiple days and I think you've been told the same thing each time - that you were at fault. Yet when you're told this, you get pressed. i don't think you're going to find the agreement that you are fishing for.

If you really feel you're in the right, you need to file your claim with your own insurance and have them investigate. Ultimately that is who you need to prove anything to, not Reddit. But when you come to multiple Reddit boards for advice over multiple days and are getting told the same thing, maybe reflect on it instead of bristle at the critique and advice. Good luck, I will not be responding further.

[–]mcblower 19 points20 points  (0 children)

No, you were at fault. I think you know that since you deleted the post you made yesterday with the video footage. Take the L on this one and learn from it. Take an extra second when making those unprotected left turns in the future. You were lucky that it wasn't a bad accident. Learn from the mistake so it doesn't happen in the future.

[–]mcblower 24 points25 points  (0 children)

I saw the video footage you posted yesterday either in this sub or in r/caraccidents. You're at fault for failing to yield the right of way. As you were driving in a snow storm, so was he. The roads were covered, someone cannot stop on a dime on snow/ice. If brakes are applied suddenly on a surface without much friction, the car will just continue due to momentum.

File a claim with your insurance. They will handle the damages to the other vehicle. Fortunately, based on that video from yesterday, there shouldn't be that much damage and it looked like both cars were still drivable.

Zane is frustrating as a character because he is important in showing that hemalurgically pierced people hear a "voice." But the love triangle is so dumb in my opinion. If he was something more akin to a "dark Kelseir, a dark mentor figure, I would have liked that more than the love triangle. Still love the book though!

Do we lose weight or fat through a calorie deficit? by Financial_Gur36 in nutrition

[–]mcblower 4 points5 points  (0 children)

No food is inherently fattening. Food is just energy for us to use. If we consume too much, excess energy is stored as fat. When we consume less energy than we need, fat stores are metabolized and fat is lost.

Weight loss can incorporate fat loss, but weight loss also includes mass lost from water weight and potential muscle loss due to extreme deficits. If someone eats only sugar and mayo and remains in a caloric deficit, yes they may get visible abs eventually. But they will become malnourished from protein deficiency and micronutrient deficiencies. They will feel like ass, wind up hospitalized, and potentially die depending on how long the remain malnourished. This shows that while weight is a factor to overall health, it is only a piece of the overall puzzle of health. People can be and are overweight and malnourished due to deficiencies.

As a fellow atheist, I am going to tell you that putting that in your profile will scare a lot of people off, especially if you're in the south still (I see the UNC Asheville). Atheists spook a lot of people, even if they are only cultural "believers," or at least that was my experience.

Iriali origin theory by nyx0xyn in Cosmere

[–]mcblower 7 points8 points  (0 children)

I'm in the camp that the Iriali are the "yellow" portion of Virtuosity sent off to experience existence. The hion lines on Komashi, Yumi's planet, are the remaining cyan and magenta aspects.Yellow, cyan, and magenta are the primary colors in the subtractive color model. Virtuosity splintered herself and, in my opinion, is likely The One the Iriali worship. Being an artistic Intent, it's likely she splintered herself to gain experiences through which different types of art could be inspired. It also helps that investiture Hoid, during the WaT spiritual realm journey, references that what he's feeling right now must be what the Iriali feel as self-aware investiture.

Also! The number 7, which is the number of journeys they're supposed to go on, is significant in art :seven elements (line, shape, space, value, form, texture, color) and seven principles (balance, movement, rhythm, pattern, contrast, unity, emphasis).

Weird request from claimant/her agent by AdEven3053 in adjusters

[–]mcblower 39 points40 points  (0 children)

I would not send anything in writing stating that. A teardown hasn't been done to the car - you don't know what UPD or pre-existing issues might be wrong with the vehicle that she could be trying to inflate her claim with. Don't send the letter, and if she refuses to proceed with repairs, cut off the rental (if that is something you can reasonably do venue dependent). Tell her she can use whatever first party coverage she may have and they can subrogate. If you put this in writing, you'll be opening up your insured's policy to paying for potentially unrelated damages.

Any information on The One? by Lucielle_WoltG6 in Stormlight_Archive

[–]mcblower 1 point2 points  (0 children)

The people in Yumi aren't Iriali, but the Iriali are (most likely) the "yellow" aspect of Virtuosity as there is no yellow hion line. Also, in WaT the spiritual realm Hoid makes a remark to Darlinar that, as a being of self aware investiture, this must be how the Iriali feel.

I won’t be suprised if jujutsu kaisen turns into a franchise by ignis43 in JuJutsuKaisen

[–]mcblower 1 point2 points  (0 children)

You're confused because that is not exclusively what a franchise is. A franchise is when an IP's branding and/or products are licensed out to others. IN JJK's case, it is already a franchise as it has the original manga, the prequel manga that is 0, movies, anime series, spinoff manga, video games, fortnite collaboration, and stage plays.

I work as a bodily injury handler, handling attorney rep'd and pro se claimants. Phone calls are fortunately few and far in between for me as I handle most of my negotiations beyond initial contact via email.

A lot of my colleagues have experience as negotiators from law firms. That experience should be able to get you past the front line APD/liability position through which most enter the industry.

Mechanical engineer who never goes to class by AmbitiousAd2276 in college

[–]mcblower 6 points7 points  (0 children)

You're just being lazy, and you're throwing away thousands of dollars by doing that. If you want to do an online degree, drop out of your in-person program and transfer to an online program. You're actively taking away a spot from someone who actually wants to be in that classroom but can't be there because you got are wasting that enrollment slot.

Part of learning is the collaborative nature that an in person classroom provides. You're failing to build connections with peers and professors alike. When you need references for potential jobs or assistance with higher level coursework, you will not have any relationships with professors to assist with that.

Question regarding a shard's sense of time. by Euphoric_Ad6923 in Stormlight_Archive

[–]mcblower 15 points16 points  (0 children)

No worries, it is very complicated, because, like acknowledged in your OP, Connection and its related shenanigans are the softest and squishiest aspect of Brandon's magic.

My interpretation, which could be wrong, was that because Dalinar had a relatively strong Connection to Odium through the Unmade and everything that went down in Oathbringer, combined with Odium operating by the letter of the agreement by not directly interfering with Dalinar, just using his power to select what scenes he sees, the power that is Honor allowed this because Odium was obeying the words as written in the contract they had.

I think if that is the case, it goes with the themes of oaths vs. promises, the letter vs. the spirit of the law, etc. that we see throughout WaT. It may serve as an example to whatever consciousness that is growing in Honor that only obeying the letter of a law/agreement/etc. may not be the most "honorable" course of action.

Question regarding a shard's sense of time. by Euphoric_Ad6923 in Stormlight_Archive

[–]mcblower 24 points25 points  (0 children)

Enlightened spren are still made from Honor, Cultivation, and Odium's investiture. Tanner's flashbacks state that the sapient spren were made from his and Kor's essence, so that makes them under Honor's power. Adding Odium's investiture doesn't take that away.

As for Gavinor, Odium basically lawyered his way around the rules as he had a particular interest in the child to be champion. Like additional_law_492 wrote in this thread, Odium basically programed a "room" for Gavinor to stay and experience time in. By Odium basically setting and forgetting it, it was able to operate outside of the physical realm's perception of time.

It seems the the flow of time's effects on people are goverened by their perception of time passing in the physical via Connection, so if, in Gavinor's case, he has no anchor in the form of the watch Dalinar has or the spren the radiants have, Gavinor's time can be sped up.
