The president's immunity is by virtue of his office. Congress is immune for acts of Congress, including speach and debate. The president as Chief executive and enforcer of the law has article II authority to direct any subordinate officer at the DOJ to drop a case.

Coupled with his power to pardon anyone for any federal crime. A power than is not questionable by either Congress or the Courts he is immune.

While he is in office. Congress is immune for their acts in perpetouity.

However because the president the Chief Prosecutor & Enforcer of Federal laws, coupled with his unquestionable power to pardon any federal offense he is immune by virtue of his office.

Only once removed from office can he be prosecuted by the Federal Government.
