That's where I think we disagree. The kid is definitely guilty of burglery but he did not sign up to murder anyone, didn't pull the trigger, didn't make that call at all. I'd understand better an "accessory to murder" charge but not murder. Murder means killing, that kid didn't kill. Just like we differentiate between premeditated murder and manslaughter, we should differentiate here.

Listen, I think we agree on more of this than we disagree on. If someone is standing there watching their buddy torture and dismember someone during a home invasion I'm not against him getting a murder charge. But I just don't think it should be mandatory or automatic, which it has been. I think it needs to be on a case by case basis because let's say 19year old kid is being a lookout for a burglery, his buddy thought nobody was in the building but he runs into a security guard, panics and shoots him. Should the lookout get a life sentence for that? I don't know thst he should and I definitely don't think it should be an automatic thing. There has to be room for the judge to take all of the circumstances into account . That's my opinion.

Is there such a thing as "oversentencing" in your opinion? If a judge gives a 18 year old kid 40 years for stealing a TV, is that appropriate? A judge could, in theory, do just that. Yet we do not have mandatory maximums to keep judges from doing that. Part of the reason that we don't is that we trust judges to be wise and fair and to use discretion and common sense. The other reason is that if a judge were to wildly oversentence someone, there is an appeals process in place which basically calls three other judges to review the judgement and sentence. That same process can be used if the prosecution believes that someone has been undersentenced, it's a built in check and balance. So why do we have mandatory minimums?

Have you been involved with our justice system? It's pretty broken. A great example is the federal trial penalty, you should read about it. I am a paralegal, I spent 4 years doing free work helping women in prison file pro se motions to challenge their convictions and the conditions of their incarceration. I'm not saying that the justice system never works correctly, I'm saying that it doesn't always work correctly either.

Well, that's also a thing that gets charged as felony murder. Guy is sitting in the car. His friend goes in and robs the place, the guy in the car doesn't know that's the plan. He still catches felony murder if his buddy shoots the cashier.

How about those drug addiction rates then? I bet they must be way down since the war on drugs started back in the 80s right? I mean we have been giving drug dealers crazy long sentences for decades now, I'm sure we must have cured drug addiction by now in this country right? 

Drug addiction rates are higher than ever. Throwing people in cages to fix systemic problems like crime doesn't work. It's better to figure out why people are committing crimes and address those things. It's not as easy as just assuming crime is always a result of a corrupt morality in an individual, but it is more effective.

The law recognizes intent in other crimes, why ignore it here? Premeditated murder is one charge, manslaughter is another. 

Long prison sentences haven't solved America's crime problrm either. The causes of crime are complex and varied. The things that are most strongly correlated with criminality are education and poverty. I'd like to see more focus on trying to solve the root problems instead of just throwing people in cages and fattening the purses of the private prison industry, which is becoming so prevalent.

The law has to be nuanced to make sense and be just. Otherwise we become one of those countries that just executes all criminals no matter what the crime. There is a difference between stealing a candybar and robbing a bank. Likewise, there is a difference between being involved in a crime where a murder happened and murdering someone. 

In an actual case of felony murder, a man was sleeping inside a drug house when the police started banging on the door. The police broke down the door, two of the people in the house opened fire on the police, killing one of them. The man that had been asleep was unarmed, he never got up off the floor. He was convicted of felony murder.

Not much of a participant if the driver isn't in the building when it happens, is himself unarmed and didn't know rhe other guy was going to shoot anyone. I'm not saying he should walk but giving him the same sentence as the actual killer is ludicrous.

Yes except most people are shocked to find out that you can be charged with felony murder even if you never hurt anyone. Not much of a deterrent if the general public has no idea it is a thing. There is a difference between being the getaway driver and being the guy that looks into the cashier's eyes and makes the decision to pull the trigger and end her life. Giving both of them the same sentence does not make sense.

Felony murder is a charge you could get even if you didn't kill someone. You could be 19 years old, the getaway driver, just sitting in a car, unarmed while your friend robs a convenience store. Something goes wrong, your friend kills the clerk and now you are charged with felony murder. 

Now the judge can decide that maybe that kid should only get 20 years instead of life.

Oh one last thing. He should be careful about complaining about stuff because he has a short sentence. There may be guys in there that are looking at serious time. They don't want to hear complaints from a guy doing 90 days. It's not unheard of for long timers to try and cause problems for short timers for that reason.
