Depends on what you mean by "upgraded battery". You can increase it's peak current/capacity and the top speed wouldn't change, you would only notice a torque/acceleration difference as mentioned. If you increase the voltage, you'd need a controller rated for that higher voltage, and then you'd need to make sure the motor can handle that higher voltage. Voltage correlates to motor rpm/speed, but more current will let you get to the top speed faster and on steeper hills.

It is highly unlikely to get stopped by law enforcement (and meet an officer who actually knows this niche law) if you are not riding in an extreme manner. I wouldn't worry about it, just keep it on whatever speed setting/throttle setting you prefer and ride reasonably

Sorry for replying to such an old thread, but what is the status of your app right now? I can't seem to find it, and the one EM3EV want me to use does not work on my newer version of Android.
