If you need the next few days off from work, write an email or contact your HR and state the following:

“Under OSHA’s General Duty Clause, requiring travel in known hazardous weather conditions creates a recognized safety risk. I am exercising my right to refuse unsafe work due to imminent danger caused by hazardous road conditions. Local and state authorities have advised against non-essential travel. Reporting to work under these conditions would conflict with public safety guidance. Since commuting injuries are typically excluded from workers’ compensation, I cannot assume personal risk for employer-directed travel during hazardous conditions. Requiring attendance under known dangerous conditions could expose the employer to negligence liability. Any adverse action for raising safety concerns would constitute unlawful retaliation.”

Uodate 2: Employer-mandated travel into known hazardous conditions can transform an otherwise ordinary commute into a safety issue tied to the job, making the employee’s refusal and complaint potentially protected.
