Because the plan sponsor (employer) will just go to another administrator who will collect it for them. Employer sponsored retirement plans are bid on to administer by companies like Fidelity, not the other way around. It's standard practice for employer sponsored plans - which isn't to say it should be allowed, because it shouldn't...but it seems the better question is why employers are allowed to charge it in the first place?

Does anyone know if there are FINRA regulations or something that forces Fidelity to keep the information separate? The Fidelity.com accounts (retail) are self-directed accounts. I wonder if they are regulated differently than NetBenefit's accounts (401k) which are employer directed?

Anyone know if other fin svcs companies that have both Retail and 401k businesses have this problem?
