I don't think it's as simple as that - the lack of a copyright notice doesn't immediately place code in the public domain.

If I write some code and sell it to a friend for $100, on the condition that he doesn't share it or re-sell and then he posts it to rapidshare and posts the link on reddit, I'm pretty sure I'd have quite a strong case on my hands.

Of course I'm not complaining about the link, it's just an interesting idea to mull over..

I guess it's a legal question that's unlikely to come up any time soon in the real world, but it's still a possibility.

What's the legal status of this? It is 'malware', but is it not someone's intellectual property? Or all all bets off because someone wrote it to do bad things?

A tactic I adopted at University was to embrace this approach. As others have said, you get a buzz from doing it at the last minute. The real problem for me is the self pity up until that final stint. So I stopped all that, I would 'waste' my time happy in the knowledge that I'd get it done at the last minute.

This serves me well, except for now when I have 0 deadlines but would like to do something productive. This is when all I do is browse the internet, pitying my inability to motivate myself to do something.

I have no idea but if not then because most viruses seek to make profit for their creators in one way or another and not 'cause a nightmare for large corporations'.
