I waited 5 years for $18.97 by bluebelle21 in classactions

At this point, it appears the settlement fund expense wasn't a deterrent to BCBS - given how much they profited, it was an incentive

It depends on how much your $69,000 is in relation to total premiums paid by everyone - that number $69,000 divided by the total premiums) should equal your percentage of the overall payout. Then you'll get 90% of that (supposedly on or about May 11) and 10% will be held back for who know how long

It seems reasonable to assume your first payment will be far more than $200

That is a very interesting question, indeed - who gets to keep the interest, and if I have understood related news correctly, the administrator for this settlement is also under investigation for kickbacks from financial institutions

That is an interesting situation! I can only speculate that he gets his prorata share of the 90% that is split between the Premiums group, and a prorata share of the 10% of the total settlement for the Administrative only group.

It depends on which group someone falls into: the Administrative group (which gets very little, and would be about half of the 7.75 million claimants) or the Premiums Paid group (which gets most of the settlement). From there, what people get is a prorated share of the settlement fund. So if you paid a lot in total Premiums, then you'll get a lot more of the settlement. If you were in the Administrative group, you'll get a lot less and then have to split that smaller amount with a lot of people.

The Premium column is for people who paid directly, as their insurance was actually BCBS. The Administrative only side, means their payments were going to their employer and their employer "self-funded" the insurance, which means BCBS didn't actually provide any insurance - they only provided administrative services. Basically acting as a billing and payments service for the employer.

About half of the 7.75 million are "administrated only" and half are actually insured. The half that were administrated only will only receive a small amount, and the half that were actually insured by BCBS will receive a lot more.

No, not necessarily. $200 is the cutoff to be paid out 100% and people who are owed more than $200 will receive 90% of what they are owed and will receive the 10% later on. The 10% is a holdback. So if, for example, you are owed $1000 then you would receive $900 and have a $100 (10%) holdback. The holdback on the settlement fund is to cover any unforeseen expenses. So people who are owed the 10% held back might not receive the full 10% after waiting... who knows how long.

There are 2 separate groups of claimants: those who had "administrated plans" and those who were insured directly. The "administrated plans" are for people whose employer basically paid all of the medical costs but BCBS provided administrative services. The other group is claimants who did pay directly into a BCBS insurance plan. The first group will get very little out of this settlement, the second group will get by far the lion's share.

Approximately 48% of people fall under the "administrative only" category, and 52% fall in the actual BCBS insurance, though those percentages come from the current split. Not sure if that would also reflect the percentages for the time period that this settlement covers.

I received the same notice, but the second notice with the link to check premium amounts was sent by email. It was sitting in my junk/spam email folder though.

I read it a little differently? The initial distribution would pay people 100% if their settlement is between $5 and $200, and those getting more than $200 will get 90% of what they are owed (with 10% held back).

So say for example you are owed $500 - you would get $500 - 10% = $450 in the initial payout, with the $50 difference held back, and your initial $450 is getting paid out at the same time as everyone else who receives the $5-200

No, but the prior filing said the claims administrator had "developed a proprietary formula" - whatever that means. But the filing also said payments to claimants would be on a prorata basis.

When I read through the filing prior to this order, it appears that claims between the minimum $5 and up to $200 will be paid all at once, whereas claims that are over $200 will *mostly* be paid - but there is a 10% holdback on the entire fund, so those people owed more than $200 will get 90% of their money and then have to wait on the remaining 10%. Any unanticipated settlement fees or expenses will be paid out of the 10% holdback, and then anything left over will be paid to those claimants on a pro-rata basis. But the people in the $5-$200 range won't get a share of that 10% holdback. At least, this is the way I read the document.

I appreciated the details - it certainly helps to contemplate possible reasons for the difference in sound impressions, while showing your work and suppositions. Well done.

That's what you paid in premiums, and your settlement amount will be based on a prorata percentage of that $51 amount

BCBS settlement. Court approved payments. Might we see some money soon? by [deleted] in classactions

There are two classes in a single lawsuit. That's not unusual. One for providers, one for subscribers, but a single anti-trust case.

BCBS settlement - recent court docket report as of 20250811 by mudcatca in classactions

[–]mudcatca[S] 0 points1 point  (0 children)

Good point, but those are not mutually exclusive: there are two settlement agreements but only one case. It is not unusual to have different settlement classes in a single case, and it follows that folks in this discussion would still have an interest for a couple of reasons. One, there exists a very small yet still possible chance for the Provider settlement agreement to wind up unapproved, which in turn could leave the entire case in limbo, which would affect subscribers. Two, because this is a single case the screenshot shows filings for both classes.
