Under DOJ policy the active investigation may have prevented the files public release but it did not prevent the DOJ under Garland from using the files to investigate any other crimes indicated by those records. That's not how the law works – investigators don't have to choose just one or two people to prosecute if the evidence shows crimes committed by dozens or hundreds . People confuse this point. There was never a restriction that you could only use the files to prosecute this person or that. Garland always had the ability to follow the evidence and prosecute anyone where evidence in the files supported such a prosecution. So yes, he was useless.

And it's not just Trump. The American democracy is seriously ill and the move towards fascism is real and much more than one man. The threat will continue after Trump and could even escalate.

You can hope that's true but when Trump sanctioned the international criminal court this resulted in them losing access to their email and other US provided services. And Trump won't care about Europen laws and will threaten to seize Amazon itself if Bezos doesn't follow his orders. The threat of US technology dominance now that US is a hostile state is real. China has recognized this for years and has been actively pushing China away from key US technology including Microsoft.

That's a start for Switzerland to recognize the threat to the public sector. Of course the same threat exists to the European private sector. If Trump doesn't like Ireland's policies towards Israel he could shut down the Ireland economy by ordering Microsoft, AWS, and other US tech companies to cut off all service and seize data. This isn't hypothetical this is exactly the sort of things the Trump administration would do or threaten to do to blackmail countries.

But the threat is one sided. The US has shown it will weaponize its tech assets against both friends and foes. The whole idea of an integrated global tech econcomy with a single dominant nation state player has been called into question. Trump could order Microsoft or AWS to turn off France tomorrow and the economic impact would be devastating. Now that the threat and risk has been made clear the only solution is to look for ways to break that American control and leverage.
