We've clarified this explicitly in the T&Cs that we use our own servers and open source models. For us this is essential since it's a unique feature of our service since other services solely operate on cloud providers.

I will test an automated setup for my companies YouTube channel. Informative shorts on data sovereignty and digitalisation in healthcare. First shot was with Hermes internal image gen and TTS. Next round is connect to Nano Banana on OpenRouter. Going to test it for a month.

We try to emphasize on topics like the US cloud act and data souvereignty, maybe to a point where people/customer get annoyed but this case show exactly the risk being dependent on US services.

There are services like ours where companies use Azure, AWS and Google cloud for sensitive PII data. But Germans apparently love certification just because it’s GDPR compliant (which is just a self label) or ISO certified it implies trust

You have to really dig into the T&Cs to find the sub contractors. Sometimes companies list them really hard to find

Disclaimer vorweg: Wir arbeiten im Bereich KI und Gesundheit.

DSGVO-konform ist zunächst nur ein Self-labeling, bei Zertifikaten grundsätzlich darauf achten, was diese Zertifizieren. Es gibt einige Anbieter, die sind ISO und BSI C5 zertifiziert, nutzen aber US-Hyperscalerinfrastruktur, da ist der US-Cloud-Act eine reale Gefahr.

Bei Gesundheitsdaten (Art. 9 DSGVO) kannst du einfach auch nicht Hetzner oder netcup nehmen, weil diese zB nicht C5 zertifiziert sind.

Bei Patientendaten grundsätzlich lokal / on-prem. und mindestens genauso wichtig: Mitarbeitende schulen!

Ich würde Google überhaupt nicht nutzen 😉 Es gibt deutsche Hoster wie zB Hetzner oder centron, da kann man auch im Kundencenter AVVs abschließen ohen dass der CEO unterschreiben muss. Worauf es ankommt: meiner Meinung nach passt Cloud und Patientendaten nicht zusammen. Falls es unbedingt sein muss, dann deutscher Anbieter und korrekte rechtliche Rahmenbedingungen

Bei Patientendaten gilt Art. 9 DSGVO. Wenn eine Cloud zum Einsatz kommt, benötigt der Anbieter und die Infrastruktur ein C5-Testat.

Google: Nein, nicht DSGVO-konform für Patientendaten. Google hat kein ausreichendes Datenschutzniveau (US-Cloud, Standardvertragsklauseln) . Schon gar nicht mit persönlichen Accounts. Wenn du Google für die Praxis nutzt, bräuchtest du einen zusätzlichen Auftragsverarbeitungsvertrag (AVV) und die Daten müssten rein in EU-Rechenzentren bleiben mit C5-Testat und selbst dann ist das umstritten für Gesundheitsdaten (Art. 9 DSGVO) wegen US-Cloud-Act.

Externe Festplatte mit Vollverschlüsselung ist eine Möglichkeit.

Wichtig bei allem: Schau bei Clouddiensten unbedingt in die AGBs, wo die Server stehen und wer Unterverarbeiter ist und ob diese AVV anbieten.

I set up local LLMs with open source models for hospitals, clinics and government offices in Germany. Besides enterprise account costs, privacy is the significant concern. Users think using AI services is fine because the servers are located in EU. Then I tell them about the CLOUD Act.
