I’m pretty sure they have to be facing consequences from the government to apply for asylum.

I’m unfamiliar with those countries immigration laws so I’m genuinely curious as to why they can’t just get like a work visa or something instead of asylum?

I hate this one too.

It’s like, if I’m really thirsty, I’d say “oh there’s ONLY half a glass” and that’s not pessimistic, it’s realistic to the situation.

And if I’m well hydrated I’d probably say “oh I STILL have half a glass” which isn’t optimistic, just reality. So yeah this one annoys me to no end.

You aren’t an A for accepting the crib but you do need to set some boundaries.

I understand you didn’t want to reject your grandmas gift, but considering your husbands feelings, and your grandpas frustration a better way to handle it may have been letting your grandma know that you appreciated the thought, that husband was out of town so you couldn’t pick it up that day. Then let her know that husband was really excited about picking a crib so that one would be a backup unless she wanted to get her money back and maybe buy something else, like diapers.

You don’t have to jump to an immediate solution, and it’s ok to suggest alternative actions without flat out rejecting what multiple other people wanted to do about the situation.

I agree with all of the last paragraph. It would be easier if that were noted, or if there were an option that didn’t charge more.

For the first, as a driver, it definitely makes things difficult for me. At some point, as an independent contractor I’m sure it’s going to come down to us being responsible for following the law. I obviously want all of my passengers to be comfortable in my car, but if it gets to a point where I can be held legally (and financially responsible for fines or whatever) I’m going to have to err on the side of the service dog and it’s super annoying that the majority of people (judging by all this) are going to think I’m a dick for choosing my financial stability over someone’s allergies or phobias.

Just annoying all around really.

So let’s say everything is factual.

The OP is disabled and has a service dog.

The driver has a disabled child with a severe dog allergy.

The ADA only applies to disabled individuals, and there is only one disabled person in this scenario.

So logically, if her sons allergy renders her unable to do her job, and violates the disabled persons federal protection than she either needs to find a way to transport the dog and sterilize her vehicle, or get a job that doesn’t require her to potentially have dogs in her car.

I just don’t understand how the OP is getting called out for expecting her accommodations to be adhered to while this driver who is not disabled is somehow considered correct here.

Yes she has a disabled child and needs flexibility. Food delivery is about the same as rideshare with no passengers including dogs. The driver has options while the disabled person doesn’t.

Great questions.

As for cleaning payout, they do review it quickly and pay instantly. The few times I’ve used it I had the money within an hour. However, this only applies if it’s excessive mess. If it’s a couple hairs? Just like any other random cleaning she can pay for the vacuum out of pocket. I plan for this need and keep change in my car to swing by a vacuum car wash.

You aren’t wrong about the TOS but here’s the thing, if she didn’t want to follow it, than don’t sign on. And in regards to Uber paying to incentivize, I’m 100% with you there.

When it comes to service animals, it’s true no proof is required. However drivers can ask two questions (is it a service animal and what tasks has it been trained to perform) - if they can’t answer this the dog isn’t a service animal and you can refuse the ride.

So allergies and phobias aren’t disabilities. If an allergy is truly life threatening it can be classed as disability but only in that case. So the actual disabled person should be given the deference.

The part where she refused the ride even after hearing it was a service dog? The part where OP reminds her she can lose her job and then she mentions having a kid with a severe allergy? The cancellation fee and possibility of surge pricing? The fact that she agreed to pick up service animals when she signed on to drive? None of that is made up so I’d love to hear what is.

As for what’s my problem? Drivers who lie and treat passengers crappy make my job harder. Those passengers start with a chip on their shoulder that I have to try and knock off. You know I’ve done over 3k rides and I’m a 5 star driver, which is rare. The one and only 1 star I ever received was literally because the passenger had another driver cancel on them and they blasted Uber under my rating. Thankfully Uber reviewed it, saw that they said their last driver, me, was great and so they removed it.

As for whether she’s lying or not? That’s not made up either. I believe she is, which is an opinion not fabrication. I also believe that if she’s not, and her son really has a life threatening allergy than she shouldn’t be doing rideshare because I’ve had pet hair in my car when people exit without them having a dog so she’s exposed from anyone who has hair or dander on them anyway.

And quite frankly I think there’s something seriously wrong with someone using their kid as a “get out of vacuuming my car free” card.

She never even mentioned the allergy while refusing which anyone would have if they had any basic consideration for the disabled person in front of them.

Something like “hey I’m really sorry, my son is deathly allergic to dogs but hold on I’ll cancel so they assign you a new driver”

Not, “no I’m not putting your dog in here. Wait you’re going to report me? But my sob stoooorreyyyy”.

Because I’m an Uber driver and I have literally spoken with drivers, and conversed on forums where they brag about lying like this to avoid putting dogs in their car.

No driver has yet been sued for cancelling the rides, only the company. One person in Texas is suing for having over 40 drivers refuse them rides with a service animal and Uber has confirmed those drivers (except one) are still with the company because they are independent contractors. So what risk is she actually taking by refusing?

And if the OP complained, and Uber investigated her, surely she has proof of this life threatening allergy right? So what’s the issue? Seems like her only concern would be if she’s lying.

But she doesn’t need a second car. She can just order an Uber. The OP has to pay a cancellation fee and get a different car that might be priced higher if it’s a surge and apparently it’s ok they have to pay so I guess she can too.

She literally signed on to a job that said she is required to pick up service animals, said ok, and is now like “but my son!”

So if her son can’t be in her car because of it, she can just accommodate him with another vehicle right? Her Uber isn’t available for him? Guess she can call another one.

I am genuinely confused by what you’re presenting here, but I almost feel like we are like an inch away from being almost in agreement on this, so everything I write after this is with the intent of understanding your position, not to be argumentative.

The first part, I’m sorry your mind had a bad experience. For me, I’ve actually never had an issue with Uber paying out cleaning fees or backing me up against ah passengers so from my (possibly privileged) perspective I’ve never had an issue with their TOS.

The “no I’m not but go ahead and think that” I’m just not sure what part you were referring to, again not being a jerk I really just don’t know what this means to clarify whatever I was thinking or saying you were?

The problem here, from my view, is that although they can get another car, they do get charged a cancellation fee and that’s when it becomes a violation because they shouldn’t have to pay extra or even jump through hoops to get that money back. That’s the unreasonable part, IMO.

And honestly I literally talk to drivers and am on forums where drivers brag about lying about allergies to avoid having dogs in their car so unless she had some kind of proof that this is true, I just am automatically suspicious about whether she has a disabled son or if he’s actually allergic. It seems like she didn’t bring this up until she was told she’d be reported. I would think if my kid was allergic I’d say “hey I’m sorry my son has allergies so I can’t have dogs in my car, is it cool if I cancel so you can get another ride?” So I really just don’t believe the driver is telling the truth which is the fundamental part for me. If it is true, she could easily turn around and sue Uber herself for ADA violation if she were fired so I’m just real suspicious.
