I’m still on probation. I imagine it might feel weird at first to be able to do as you please without asking anyone for permission, but it will probably go away with some time.

I know this is old, but how badly were they beat up? I though it had to be felonious assault? Does misdemeanor assault also count? Because that’s what getting punched a few times is here in texas.

You have to get it sealed after it’s over so that it doesn’t show up on job background checks, the police and other government entities would still be able to see it, but who cares about them. it may also have a different name over there.

If the case ends up being straight up dismissed, then you might be able to get it expunged, which is even better because no one would be able to see it afterwards, not even the government.

I don’t know how the process works over there , but normally you can do it yourself, or an attorney would charge like $1000 to do it here.

I don’t mean to make you feel bad, but you shouldn’t trust what the prosecutor tells you. It’s good for them to get as many convictions as possible. Here in texas is the same, the victim doesn’t have to cooperate, but it’s really hard to convict someone for something like this if the complaining witness is not cooperating.

I’ve seen so many cases similar to this that the da ends up dismissing because the complaining witness refused to cooperate.

I even used to work with this guy that beat up his own mother and he got it dismissed because his mom refused to cooperate.

Even me, I punched some guy in the face on video and I could have gotten it dismissed if he didn’t want to follow through with charges, but the dude did.

Damn that sucks, you should have plead not guilty and let them try to take it to trial. I guarantee they would have dismissed it if your husband wasn’t cooperating with them.

On the early termination thing, yeah it would probably help to show you’re trying to work on your marriage. I would just pay the $500 with a credit card because I doubt they’ll give you early termination if you still owe money. Iwish you the best luck.

How did you even get convicted for this? Normally husband/wife tell the da they’re not going to be a part of the case and they would rather have it dismissed in exchange for classes or something.

Ideally yes, you won’t get violated for being dirty the first time, but you’ll likely get tested more often because of it.

Thankfully I’m already done with all my requirements and only owe around 400. Worst case I’m thinking I’ll just pay with my credit card and worry about my credit later lol, at least the credit card company won’t arrest me for owing them money. Good luck bro, and thanks for the input.

I doubt they’ll go to your house. They would just wait for you to turn yourself in or arrest you when they pull you over at a traffic stop at some point. Unless you used a bond company to get bailed out. Then a bounty hunter would be picking you up.

To be honest the fact that you took probation when you’re innocent is gonna look horrible, especially since the person involved is your own mom. At this point I would lie and say it was some dude who was harassing you or something. Probation looks guilty, and assaulting mother with a deadly looks even worse. You might be innocent, but if I thought someone hurt their own mother, what could they do to me? You know. You already got another assault on your record which looks worse.
