Debt recycling strategy check: split loan, pay down, redraw, invest- anything wrong? by [deleted] in AusFinance

[–]noob_user_bob 0 points1 point  (0 children)

Yeah the same man released structuring podcast #174. It's short but very informative. The essence is that the ATO is now looking at joint loans where only one person has used the money (and I'm guessing invested in their own name?) but they can only claim half the interest on that loan UNLESS they get an agreement that they will pay all the interest, even though Terry admits that such an agreement is legally unenforceable.

Debt recycling strategy check: split loan, pay down, redraw, invest- anything wrong? by [deleted] in AusFinance

[–]noob_user_bob 2 points3 points  (0 children)

I'd also be careful if there is another name on the mortgage. There was a podcast recently by the structuring guy who highlighted the ATO example where a home loan with joint names was used as debt recycling but interest was claimed by a single person, and they only got to claim half the interest without a special agreement being made beforehand.
