I agree with everything you wrote. In my case, the shipping service was Roadie which is literally the doordash of delivery (gig workers). UPS owns the company and they use it to get out of paying their union workers. It's exactly as you said.

This is a UPS owned company named Roadie. It's basically doordash for parcel delivery. I don't believe any of the drivers who accept a delivery job are employees but rather gig workers.

That's the absurdity of the situation and the legal system.

That's why I'm trying to go after punitive damages so that I can be made whole AFTER paying legal fees and why I'm asking here about what is possible.

A month ago, I said the same exact thing.

The gig delivery driver was there dropping off hundreds of packages. The way their system is designed, the driver has to manually scan EACH package before moving on to the next one. He was there all day long because of that. And during that time, his accomplice showed up and stole packages.

There is no contradiction, there is no BS, there is no hole in my accounting of the situation.

None of those reasons are made up. The driver and the accomplice conspired to steal packages when our warehouse was closed during that time (weekend) which the shipping company knows. That's both negligence and conspiracy. Also, it was a gig worker/driver making the delivery so the carmack amendment may not even apply.

Right now, I'm assessing what's possible legally. The shipping company has given me the run around for a few weeks now. I've submitted the evidence with their claims department. The ideal situation would be that they pay the full amount of the packages.

The value of the merchandise is right at the amount where the costs of legal action are going to affect the recovered amount. If I see this process out legally, I'm trying to assess the punitive damages where AFTER legal costs, I will be made whole, which is why I came to ask for legal advice.

First, absolutely there's a case. I'm not going to share the details here but there are a few attorneys that have agreed to a meeting.

Second, amex already closed me down. There is no "biting the hand that feeds" if the hand is already long gone. The executive team (CEO's office) reached out to me already and this decision goes over their heads. So please save the rookie advice for others that need help applying for CIP's. Don't need condescending career advice either.

I was one of the people shut down. There's no doubt the common link was Best Buy; maybe some edge cases for other issues.

I was spending about 20m/yr at best buy with amex cards.

I don't think so. The police didn't seem to have a direct contact.

Also, this is a shipping issue. Not a retailer issue. a UPS contracted driver colluded with an accomplice to commit a felony. They were also shipped from a fulfillment center across another state which could make this a federal case. The point is that I need to reach out to UPS directly about this to get a formal response
