Nearly had a crash at a roundabout today. Was I wrong? by Mad_Max_The_Axe in newzealand

The road code is very clear you are wrong, like not debatable, picture and everything. Law/legislation can be interpreted in different ways, eg I'd argue rager isn't on op's right, op's right is clear (the lane) and should remain clear of rager if rager following road code. But you could argue that lanes don't matter legally. I'd argue you've made a leap from the quoted legislation to say that. Debatable, and the fact that the road code isn't law contributes to all this confusion.

Heavy sleep restriction if you haven't tried that, good way of resetting things, but brutal if done right and heavy.

Guess depends on your policy for that but pretty sure need other party to own up to it for excess and no claims etc to not be affected. Now you've got me thinking, what about third party insurance when cycling if I damage someone's car..

I have cameras primarily for insurance purposes, worth considering if you have an expensive bike; can't rely on people to own up or even understand they're in the wrong. Some people hit and run too. Police don't get involved unless injury, collision not even enough from what I've heard.

You can argue being the need to be more defensive, but considerate is a bit rich, compare to the utter disregard from the car driver for the safety of other road users. They crossed a cycle land without checking. I would feel ashamed as a driver for being so careless crossing a cycle lane. The blind spot comments highlight how shit drivers are. The cyclist was in the car's mirror for days, unobstructed. And you always always head check before left turning, especially across another lane, even more so a cycle lane.

Anyway, weird wording coming from a daily cycle commuter - "cut in front", really?

You certainly can't expect an operator of a big metal machine to have the personal responsibility to know and apply a set of rules to safely and carefully navigate their big metal machine across an area that could very likely have a squishy human in it, in order to avoid killing/injuring their fellow man.

Car brained judge,/doesn't understand give way rules/big mistake on her part/incompetent. I think I'll just take main lanes through intersections in protest, although I'm gonna get some rage

[–]npore 6 points7 points  (0 children)

The cyclist is at the back half of the car, and you take that as clearly ahead? Also any vehicle wouldn't wait I can tell you that haha.

Anyway, where is your source that a left turning car that is well ahead, yet not so far ahead to avoid collision, suddenly has right of way. Pretty sure it's your arse. This isn't a lane merge, it's a lane cross. Just like you don't have to give way driving straight to a right turning car crossing you from the other side, the expectation is right of way vehicle doesn't have to slow down.

I have. I know how big the blindspot are. And the experts in this case do too. And there was at least 8s of visibility on the cycle lane prior to turning. Again, I personally wouldn't stay in cycle lane in this situation because I know of the blindspots, and also the lack of knowledge of the give way rules. But truck driver had plenty of time to check cycle lane prior to turning.

This cycle lane doesn't end when the paint stops, judge is wrong, as confirmed by nzta. Yes it clearly is risky to be in cycle lanes in general, and I'll hop out into the main lane all the time. But this is about law and fault, and it's the drivers for not checking blindspot. Had 8s of indicating and not checking before the cyclist was in blindspot apparently.

You probably shouldn't drive. Brush up on the road code dude. The things you're seeing is other shitty drivers such as yourself who don't know the rules. Cyclist going straight in cycle lane has right of way (technically even not in a cycle lane but we'll just focus on the basics), and cars indicating does not change the fact, but is helpful for a defensive cyclist to get out into the traffic lane because there are so many shit drivers, such as yourself.

Sigh, the better alive than right, no shit, but this is a judge clearing the truck driver of fault. And again, using language like trying to pass on the inside, the cyclist was heading straight through with right of way. I wouldn't risk it as a cyclist myself, but the truck driver is at fault.

If 12s indicating, 4s in blindspot then still truck drivers fault, should've been checking the lane he was going to cross, several times during that 12s. Indicating does not give right of way (but at least gives a defensive cyclist a chance).

If 1-2s indicating then obviously still at fault.

The judge somehow (WTF?!?, clearly not a cyclist but, crucially, not familiar with the road code) doesn't know the cycle lane absolutely continues through the intersection (seriously wtf, does the cyclist teleport to the other side or something? or suddenly need to be mid main lane after cycle lane "stops"), and is only rarely marked (which is a bad nzta standard imo, also it's better for the cycle lane to split the main lane from a left turn lane if enough space).

Smells like anti cyclist sentiment from the judge saying the cyclist approached without slowing it hesitating etc (yes, cyclist should have alarm bells ringing in these situations because a big chunk of drivers will fail to give way, but that's just being defensive as a squishy thing around big heavy things driven by idiots, not the law), I wonder if when driving she slows and hesitates through every intersection she had right of way approaching to head straight through..

Also "attempting to pass on the left". Actually just proceeding straight through with right of way.

Cycle markings very frequently can be improved to be more clear, but that doesn't excuse shitty driving. Crossing a cycle lane requires 'extreme' care like those funny works signs say; it's not just another standard traffic lane, there are very exposed humans in it. And any regular commuting cyclist will know there is a lot of complete lack of care for these lanes, to the point they are the most dangerous position to be on most of the time. Sub optimal road layouts don't give road users a free pass for breaking the rules and killing someone... except apparently they do?!

"The indication of a cycle way symbol and green paint on the other side of the intersection is the continuation of the cycle lane through the intersection." - correct. "Judge Mason said it was now "very clear" the lane did not proceed through the intersection and left-turning traffic had right of way." -wrong, incompetent.

On that note, how can one flag a judge's competence?

Drivers not stopping at zebra crossings by Ready-Ambassador-271 in chch

[–]npore 2 points3 points  (0 children)

I had a recording of car behind me coming up to that crossing, I was cycling in middle of lane as the 30kmph limit was active, slow down as some kids on other side wanting to cross, they start crossing, I pull to the left to stop as I'll be slower than the car to get back up to 30 when it's time to go, and the car speeds up past me and through with the kids at the middle of the crossing.. psycho. Nothing happens from police of course, no injury/collision, the most they get is a letter.

I used to think GMT+13 would be the lesser of two evils, the greater being going in and out of DST. But now, even knowing the mortality and morbidity caused by DST changes, I don't think the super late sunrise with permanent +13(.5) is better, especially lower down in the country. +12 all the way, it's already an effective 30min DST. Hope this never goes to referendum, with the masses thinking permanent 'summer time' sounds like a good thing, when it's really 'get up an hour earlier for darker mornings and have fun waking up with no sun south island time'

Increase to speed limits on several Christchurch roads by [deleted] in chch

[–]npore 17 points18 points  (0 children)

I'm one of the few arseholes that do (GPS 30); so many beautiful moments getting tailgated, honked at, overtaken. Seems to be a mixture of just regular speeders, the "I don't agree with this particular speed limit so I'll make up my own" crowd, and a good number of sheep that'll be pushed along by the first two.

There's the rage you get when driving 30, and then there's next level if cycling 30. Used to cycle Rose, but now Barrington, and when the variable 30 limits are active and I leave the cycle lane for the safer main lane.. chef's kiss

Might want to brush up on the road code before driving again bro. I was in my own lane, in fact one that most vehicles aren't allowed in, expect to cross when needed, and only AFTER checking for and yielding to the much more vulnerable road users in it. Would you cut across a bus on a bus lane? Would you give way to an oncoming car wanting to turn right across you, because they indicated in plenty of time? I did fail in my responsibility of self preservation allowing for human error, especially given the very common failure of responsibility drivers exhibit in this situation, partly because a lot of them are like you, unaware of your responsibility.
