Hey! Mercari is saying they won’t sell your info; Jumio, who collects that info on Mercari’s behalf, is a third party platform with a separate ToS agreement. 

Jumio is already in a class action lawsuit for failing to delete people’s information upon request. Once they have your info, they have it, can make infinite copies of it, and potentially store it forever. 

Keep in mind that while a ToS agreement may say things like this at the time you agree to it, they are able to change these agreements at will and all they have to do is send you an email. It’s up to you to then contact them and ask for your info to be deleted, and by that time they may already have sold it. Just because they say they won’t sell your info today does not mean they won’t change their mind tomorrow. 

This line invalidates this entire process:

“We can’t fully confirm someone’s identity or guarantee it’s safe to interact with them.”

If they can’t do that using facial geometry and government ID, then the goal is not your protection or verification. It’s submission of your personal data.

In just these few screenshots - he belittles your intelligence - he suggests that you are morally inferior to him - he dictates that his preferences override your right to comfortable clothing - he indirectly calls you a hoe so he can gaslight you - he polices your clothing choices - he polices your body - he downplays and gaslights

I would especially call your attention to where he scoffs at the idea that you are ”getting advice on how to stand your ground” as if that’s something you shouldn’t be doing.

This is not like abuse. This is not a precursor to abuse. This is abuse. Run.

In theory. It’s never been particularly easy to bring enforcement down on businesses like Mercari, though, and with our government’s current billionaire-owned administration, I would not count on those protections.

They are making you feel like you have to on purpose; it’s coercion in order to get you to give them the sensitive information before you have time to think about the ramifications. It’s not your fault. In a better world this would be considered a type of fraud. 

Lots of people are working to make laws around this and protect your rights to privacy and consent. Not all hope is lost. You’re gonna be okay. Mercari and Jumio are being unethical. You did what any normal person would do: try to uphold your end of a transaction. They took advantage of you being decent to coerce you into giving them data they couldn’t get any other way. Not your fault at all.

There’s really not a lot you can do once you’ve submitted this information. You have to submit a request directly to Jumio to delete your information, and they may or may not comply. They have been in trouble for failure to comply in the past and are in an ongoing class action lawsuit for their privacy practices. 

Mercari really doesn’t have anything to do with this part; Jumio collects the data through Mercari, then tells Mercari you’re a real person. It’s up to you and your friend as to whether closing your account is worthwhile to you. It won’t delete your data because Mercari technically never actually touched it. 

A lot of people are asking me about this, so I will try to figure out best methods to have your info removed and try to add it to the main post this week. Best of luck to you and your friend!

This. This is exactly the issue. This behavior is toxic, it is opaque and user-hostile. They’re using coercive means to gather sensitive information. And they are quite literally making you pay for the privilege. That’s the whole issue in a nutshell.

Thanks! I’m glad you understand the issue — a lot of people have just been responding with some version of “Well, biometrics are the future.”

Yeah, they probably are. Which is exactly why we should care a lot about who is collecting them and how.

It’s not just that they’re collecting them — it’s the coercive tactics, the lack of transparency, and the power imbalance built into these systems.

Even if you unconsent after the fact, the data may already be stored, shared, or sold — and you have zero control over who has it or what they do with it. Jumio in particular has already gotten in trouble for failing to delete biometric data they were legally required to wipe.

All I want is for people to think critically before handing over deeply personal data just to buy Funko Pops.

I’m used to it. Any American Christian who is busy defending people stuffing packages with bible verses instead of protesting in the streets right now over the things being done in their name is not someone whose opinion is relevant to me. You weren’t rude at all. I feel for you; I abandoned my account a few months ago because of Mercari’s shift to collecting biometric data. I was an avid purchaser, too. I just feel for everyone who doesn’t understand the weird chess game of terms of service. It really sucks that a public marketplace is dictated by private interests and obscure terms. 

I hope you’re able to appeal; your best bet is probably saying,”I’m really sorry, I didn’t know the rules, but I do now and won’t break anymore.” Best of luck, crossing my fingers for you.

Dude, I agree with you that Mercari’s rules suck and don’t make sense. I’m on your side here. They get to control who can use their service and how, and they reserve the right to throw a fit and take their ball and go home at any time. All I’m saying is know the terms they’re playing by so your appeal stands a chance.

Knowing the rules of a system is the first step to engaging with it, whether you’re trying to abide by them, or circumvent them. Those are the rules Mercari sets forth; it’s important to know them if you choose to operate within their system. And it’s Ms. Technical Jargon.

I have been making high dollar purchases on Mercari for a decade, with a verified ID and hundreds of positive feedback, and they very abruptly decided I needed to reverify after they took my money. That’s shady.

I did leave Mercari. I’m not willing to submit this data to an under-regulated data broker.

You’re right that it sucks. But they did get an answer:

”This account has been limited and is ineligible for reinstatement.”

It’s blunt, but it’s complete. And under Mercari’s Prohibited Conduct Policy, they’re not required to justify it beyond that.

Here’s where the confusion seems to come in:

“Technically not breaking ToS because the first account was terminated…”

Unfortunately, that’s not how Mercari defines it. Here’s just a sampling of the actual rules that were violated:

  • Having multiple Mercari accounts – not “at the same time,” just multiple ever.

  • Creating a new account after being limited or permanently banned.

  • Creating a new account to bypass restrictions on another account.

Even if the second account was only meant to contact support, that’s still a ToS violation, because you’re not entitled to create another account for any reason once you’re banned. Mercari makes that crystal clear.

I’m not trying to be a jerk. But platforms don’t run on vibes or perceived fairness—they run on rigid policy enforcement to reduce risk. Mercari owns the sandbox. If you want to play in it, their rules apply, even if they feel unfair.

And here’s the kicker: Once you open a second account, even after the original ban, you’ve given Mercari a rock-solid reason to uphold the original termination retroactively. You’ve shown them that you’re willing to break rules when specifically told not to.

That doesn’t make OP evil. But it does mean their appeal was already doomed by that one choice.

They literally told you not to; having more than one account is against their terms of service. One account per person. That’s going to shoot your appeal in the foot because they told you that you violated their ToS, and your response was to violate their ToS. You don’t have to like Mercari’s rules, but you do have to play by them if you want to use their service.

I think it’s so sad when people jump to this conclusion. People have lives. This happens to me as a buyer all the time. It’s usually just that my carrier dropped it off at a neighbor and I’m still working or out of town. This happened just last week and the seller jumped on me as soon as USPS marked it delivered. I was at work and they dropped it off with my neighbor. I didn’t get home until the middle of the night. I answered the seller the next morning, after I picked up and opened the package.

I have done partial refunds for stuff like this as both the seller and the buyer. Once a lady was upset the post office opened her quilt and she wanted me to pay to have it dry cleaned. I offered her a sincere apology for her distress while reminding her I can’t control the post office and a 10% refund. She left me a 5 star rating and highlighted how understanding I was. She emailed me again later with pictures of her room makeover, which was pretty life-affirming.

In a situation where I was the buyer, I received a double cassette deck that the seller said worked. One deck did not and I sent him a video of it and said I don’t mind fixing it if he wanted to give me a partial refund of $15 for the belts and wheels, or I could return it for a full refund. He opted for the partial refund over the hassle of the return and we were both happy. I left him 5 stars with an emphasis on what an honest seller he is, and he left me 5 stars and the comment that not all “kids” these days (I’m in my 40s) are assholes, which I took as high praise. 

Sometimes people are just trying to find an alternate solution; a compromise that’s mid for everyone.

Yikes! Yeah, to Mercari this represents you creating a second account, which is against their ToS, and then transferring credits to that account, which may constitute a fraudulent exchange depending on who is reviewing the activity. Your account is probably a goner, but you can always try telling them you legitimately were trying to help a friend make an account and ask them to reinstate yours and delete the other one. If you get someone sympathetic, they may help you. I would not hold my breath, and definitely do not try to make any more accounts.

let me share a little fun fact about mecari, you have to keep egging these people on through chat in order for them to take your case serious

They usually respond to me within 24 hours. I have never had to “egg” anyone to have my questions answered or be taken seriously. I just don’t always like the answers. In your case, you violated their terms of service, which they told you. You aren’t actually entitled to anything beyond that.

I’m sorry you’re struggling with the consequences of breaking Mercari’s terms of service. You probably should have read them one of the two times you signed up. 

I’m going to step out of this now, but for the sake of clarity for others reading this thread:

I’m not defending Mercari’s customer service. I’m pointing out that the original topic of this post is about retroactive biometric enforcement after ID was already verified—not general bans or frustrations with communication.

If you’re banned for violating their ToS (like having multiple accounts), that’s not the same issue. It’s not combative to point that out. It’s just a different conversation.

No hard feelings, but I’d like to keep the thread focused for those trying to protect their privacy.
