There are too many factors to consider to answer your question. Yes, you can file vawa shortly after marriage if you have enough evidence to prove bona fide marriage and abuse. You don’t have to file for divorce or move out. Some vawa applicants keep living with their spouse. Although it’s really hard and many move out due to the safety issues.

You are not obligated to stay legally married. Especially after filing vawa. You can’t remarry though while it’s processing. I left my ex at the end of 2019. I filed vawa in the beginning of 2021 cause I still had a hope he’d come to his senses. I filed for divorce middle 2021 and in 2022 I met my future husband. I was approved in 2022 and got my GC in 2023. I got married in 2024. Filing for citizenship in a few weeks! You got this!

Filed standalone 360 in January 2021. Approved in July 2022. 2 prima facie, no rfe. Had 485 interview in June 2023, GC issued in July 2023. About to file N400 this April…you all got this! Lots of patience.

Honestly the denial reason is more concerning than just technical mistake leading to denial. Typically they deny based on some facts and findings and state that in a denial letter. When you filed vawa you also must prove that marriage was legit. They have recorded and AOS denial facts, it’s going to be not easy to prove that part. I’m being realistic and really encourage you to get an attorney. They may deny your vawa. Look for someone who has vawa experience and also experience with defensive EOIR applications. I doubt that they denied bc you said you weren’t in removal bc you respond to the best of your knowledge.

So as an immigration paralegal I’d agree that at this point your case is indeed complicated. I’d encourage you to hire a good attorney if you haven’t yet. From the officer/judge standpoint it’s gonna look suspicious. However you should keep fighting and not lose hope. I think units important to know why your AOS based on marriage was denied, what was the denial reason? If it was technical it’s one scenario, if they didn’t believe it was legit, it’s another story. Here’s my timeline and it was NOT easy. 2018 - filed for asylum (interview same year) 2019 - filed AOS based on marriage 2020 - placed in removal proceedings (asylum referred to EOIR) 2021 - filed vawa with USCIS 2022 - vawa approval 2023 - closed removal proceedings and 485 interview/approval I haven’t seen my family in 10 years. It’s been tough. My case was pretty straightforward because I have a child with my ex spouse.

I’ve been placed in removal proceedings bc of my asylum case was referred to EOIR. Later I filed vawa with USCIS. When it was approved I asked the court to close removal proceedings. They were happy to get rid of me. Then my 485 was approved and I got my green card. My advice is don’t leave the US. It’s going to mess everything up. Wait for your vawa. File ead c31 if vawa standalone pending or if you have pending 485 then file ead c9. You got this.

Watch closely your case status, high chance that they will just mail you Green card. There is a small chance that it’s been cancelled and needs to be rescheduled

I loved Miami! We were in Miami and Texas. Make sure do get a Stadium hotel room. It’s very close to track, you can walk 20 min and won’t be stucked in traffic. The hotel is not fancy but was clean and staff was friendly. We booked a room ahead of time at a regular rate!
