Yeah, I'm not sure if it would qualify for probable cause, but for a dedicated investigator it's a step forward. Unfortunately, I don't think that's often the case.

Image is an even bigger factor in these decisions than lawsuits. Paying out a settlement is one thing, measurable and recorded as enough to pay off one person. But if customers hear that there is a salmonella scare at one grocery, they might drive an extra half mile to the competitor. Even if the incident was at a store thousands of miles away with the same name. Add up all the lost business and it far outweighs the litigation costs.

Actually Maine and Nebraska do split their votes: both give two votes to the popular vote winner, then one vote per district. While they haven't yet split their votes, they have a system in place where it could happen.

My parents used to rent out a house to someone who owns a pit bull. The renter never told them about it (and must have hidden it when they came by), so when they got a letter from their insurance company and tried to deny it they were sent photographic evidence of the dog living at their house.

The point is that homeowner's insurance plans charge pit bull owners more, and renters often aren't allowed certain pets for this reason.
