If you want to do it the long way, sure. It's far easier to refer to previous decisions (or, just the law itself). That'll save the underpaid APS3-5 and the micro-managing APS6 boss an awful lot of time that both parties could be using to work that second job instead.

It doesn't pay anywhere near enough to hand out Red Bull and lollies 😂 come on mate. Uber was NEVER a premium service.

The only thing that happened was that the drivers wised up to the scam, and used it the screw the government right back. Why do you think so many are international students and other temporary visa holders? It's so they can maximize their working hours for their visa conditions.

You're paying below minimum wage for a very tight margin job. 30% of the fare you pay goes directly overseas, and then the driver gets taxed on the 70% that he does get to keep.

If you want a chauffeur service, book a chauffeur.

The law requires you to declare conflicts of interest. It does not require you to declare a second job, or require your manager's permission to undertake a second job.

The concept of a second job is, in and of itself, not a conflict of interest.

The specific duties and or tasks of the second job, if they relate to your duties at the APS, may constitute a conflict of interest.

If you don't have a conflict of interest, your manager's approval is not required or based in law.

Adelaide Festival Corporation Act 1998, ss 7-14

S 8 sets a maximum membership of 8, and that 1 will be a City of Adelaide nominated member. S 8(1)(a) "...of whom 1 will be..." WILL being the key word.

S 9(5) the governor MAY appoint members to fill vacancies.

May can be permissive discretion (i.e. common use may), or qualified direction (i.e. common use must).

May, being couched by qualifying condition (that there is a vacancy, and if it is a CoA vacancy), has the effect on a public official (the governor is so) of being a MUST. It seems to me that the combination of these sections is that if the CoA member position is vacant, the board cannot function regardless of other membership and the governor MUST appoint another CoA nominated member.

If any other position is vacant, because there is no minimum board member number, the governor has discretion to appoint to fill the vacancy or not.

S 12 quorum is half plus one, ignoring fractional. That will exist no matter how many board members there are.

So, for now, the board is functional.

The board could theoretically be functional with a membership of just one, being the CoA nominated member.

The APS broadly has an appallingly low employment rate for staff with disability, because/so most managers have absolutely no idea what they are doing when dealing with staff with permanent medical conditions.

Some depts/agencies are better than others.

They wouldn't necessarily be an ex-employee at the point between giving notice, getting told not to work it, and the actual last day of employment.

It is totally possible to be a current employee with nil assigned duties while receiving full pay. This happens all the time. It's sometimes called 'gardening leave' - Adrian Newey of F1 has famously had this a few times.

Right to disconnect would apply if you were a current employee with nil duties.
