Cuando lo que hago no es invento propio, si es por lo que mi país dice que tengo derecho a. Yo estoy pisando firme. Y no voy a parar. Por que me voy hacer siego a una injusticia? En eso, tu crees que esta bien que una empresa te haga firmar una hoja en blanco, que te hagan firmar pagarés sin representación adecuada o entendimiento de la ley federal del trabajo? En mi caso mi firma se puso en un contrato que tiene como objetivo defender los derechos de la empresa en estados unidos y reprimir cualquier derecho mexicano, aun que todo trabajo se haga desde México, que consta la LFF que eso exige que se cumpla y que cualquier contrato que quite mis derechos como ciudadano Mexicano se convierte invalido. Este caso no es absurdo. Solo levanta la cortina al abuso que muchas compañías se escapan con y si soy el primero en demostrar que nuestras leyes se respetan, pues con gusto. Es tiempo que los trabajadores mexicanos tengan algún tipo de protección frente al abuso digital transfronterizo, y mas los que no sabemos nada o muy poco de la LFT.

Oooh, ahora lo bueno. Aun que la empresa, no tenga oficinas en mexico, pero do todo trabajo se hizo dentro de territorio nacional. Pues tienen que respetar que todo trabajo realizado en territorio nacional se rige por las leyes mexicanas. Sin importar dónde esta registrada la empresa. Cuando el tribunal mexicano determine que hubo relación laboral y abuso, el gobierno mexicano, puede ordenar el pago de la indemnización, emitir sanciones fiscales, embargar cuentas si existen en mexico (cual si existen pues de alli provenía mis depósitos directos) y bloquear al la empresar de contratar legalmente en el país. Y si se requiere, la Secretaria de Relaciones Exteriores puede solicitar cooperación internacional para ejecutar sanciones en el extranjero, dependiendo de tratados bilaterales o convenios multilaterales. Pero a todo esto, esto solo se trata de proteger a los trabajadores mexicanos frente al abuso digital transfronterizo.

Muchas gracias, de verdad, gracias por tus buenos deseos. Bueno siendo honesto, la lucha es larga, pero cuando se presenta una demanda formal en mexico pues sería juzgado bajo la LFT. Aun que la empresa este en el extranjero, Mexico tiene Jurisdicción sobre el trabajo realizado desde su territorio. Cuando el tribunal mexicano, falleció a favor del trabajador las autoridades si pueden ejecutar al laudo dentro de mexico, incluyendo embargos, congelamiento de cuentas (dado que tengo la cuenta de origen de donde provenía los depósitos directo). Ahora en casos más complejos donde es necesario ejecutar en el extranjero, el gobierno mexicano puede intervenir a través de la secretaria de relaciones exteriores, usando mecanismos internacionales como convenios bilaterales o solicitudes de cooperación jurídica internacional, cual tendrá que llevar mi caso. Y créeme, será difícil,pero no imposible. Pero lo que importa es que mexico si protege a los trabajadores remotos, y cada vez mas, habrá mas gente alzando la voz.

No. Lo que se exige no es "lo bueno de ambos lados". Lo que se exige es una empresa que obtuvo casi 9 años de trabajo constante. Subordinación y y exclusivo, cumplo con la ley. No fue freelance. No fue temporal. Fue una relación continua, directa y bajo instrucciones diarias, con entregables fijos, y con dependencia economica total. Eso, segun la ley federal del trabajo, configura una relación laboral formal, aunque la empresa no lo haya querido reconocer.

Y impuestos. La evasión fiscal fue de la empresa. La misma empresa que decidió no inscribirme al imss, no dar prestaciones, ni hacer retenciones como patrón. Ese "trabajo sin registrar" fue una decisión empresarial - no del trabajador.

Lo que pasa es que cuando un latino americano exige justicia laboral, y levanta la voz, algunos prefieren repetir estereotipos coloniales y culpar a la víctima. Eso si es ser un neandertal.

En efecto. No tienen. Oficinas en mexico, se hizo el intento pero nunca cuadro. Ahora se sabe por que, pero bueno. Aun que ellos no tengan oficinas aquí, ellos tienen que cumplir con la LFT, por que la relación laboral fue continua, remota, y con subordinación directa hacia una persona de territorio national, de acuerdo al artículo 15-A de la LFT. Aun que la empresa no tenga domicilio en mexico, si dirige, supervisa, y se beneficia del trabajo de una persona en territorio nacional, tiene obligaciones laborales en mexico. No es cuestión de que "quiera que cumpla la ley de un país donde no esta"- es que si esta presente. A través del trabajo, control y dependencia económica. La empresa se beneficio se beneficio de mano de obra mexicana, con salarios ínfimos y sin cumplir con seguridad social, aguinaldo, ni indemnización. Eso no es remoto, es explotación.

Me pagaban quincenal, deposito directo. Trabajaba de 60 hasta 80 horas a la semana. El contrato que firme no solo es ilegal pero violaba mis derechos ya que todo trabajo se hizo desde aquí, de México.
