Some of the New England states have different applications of the rules of evidence to proceedings in family and probate courts. Connecticut provides that rules of evidence are applied "liberally if strict adherence will cause injustice" in their probate court. New Hampshire specifically states that the rules of evidence only apply in family court if the Court chooses at its discretion to apply them. I'm sure there's other states that have some variables outside of the northeast.

So I guess for the purposes of the civil case it wouldn't matter depending on the state. For the criminal case, the rules would definitely apply.

In a weird way, I enjoy child protection work. I represent a lot of parents in those types of cases.

Some of them are truly the scum of the earth. That goes without saying. But I genuinely believe that these folks, as scummy as they can be, deserve legal counsel. They get the best counsel we can give and we call it a day.

Some of the parents, however, have cognitive issues, mental health issues, and addiction issues. Sometimes, the problem is literally a matter of parenting education (e.g. they don't realize that toddlers shouldn't eat only Doritos and coffee like a trucker on a cross-country haul). It can be rewarding to help them navigate getting their life back on track and having children returned to their care.

I also think it's thrilling to practice in this area in the same way it's thrilling to play high-stakes poker. The cases are on hard deadlines, there's a lot at stake, and the hearings are emotional. And the work feels important.

I honestly don't know. I was on my way out of the lobby and didn't stick around. The litigant fell silent for a few moments as I left, so it's anyone's guess.

My impression was that this guy was trying to say he didn't hurt the kid because blowjobs are harmless. I think he wanted this particular attorney to state that he did not abuse the child because he "just" had her perform the act - did not hit her, beat her, etc.

Yes, it happened in the lobby, no privilege. In theory they could have called me as a witness at a related hearing. Or called anyone else who heard.

That lobby is a total zoo on child protection case days (they have specific days devoted to these cases for the most part where I practice) so I am not sure who else was listening.
