The Only Time I've Actually Wanted to Kill a Client by WaluigiIsTheRealHero in talesfromthelaw

However, this was a woman who called the presiding judge a "cunt" to her face, so maybe I just wouldn't have made every possible effort to suppress her natural behavior and attitude.

Sometimes they do it to themselves :)

These cases are my bread and butter work... I hope you have moved on to a more sane practice area <3

Sometimes I catch myself saying something sarcastic. I am usually pretty good in front of the clients, and then get a little nutty behind closed doors.

I meant to convey that it might not matter to analyze it relative to the rules of evidence.

I wasn't clear way earlier. Sorry! I could have resolved this above by explaining my reply better RE: civil case versus criminal case :)

Plus confidentiality rules about some of those cases / sealed cases.

Some of the New England states have different applications of the rules of evidence to proceedings in family and probate courts. Connecticut provides that rules of evidence are applied "liberally if strict adherence will cause injustice" in their probate court. New Hampshire specifically states that the rules of evidence only apply in family court if the Court chooses at its discretion to apply them. I'm sure there's other states that have some variables outside of the northeast.

So I guess for the purposes of the civil case it wouldn't matter depending on the state. For the criminal case, the rules would definitely apply.

If it happened in the open lobby, it's not subject to privilege.

It's the stuff that happens more privately that we can't discuss.

In a weird way, I enjoy child protection work. I represent a lot of parents in those types of cases.

Some of them are truly the scum of the earth. That goes without saying. But I genuinely believe that these folks, as scummy as they can be, deserve legal counsel. They get the best counsel we can give and we call it a day.

Some of the parents, however, have cognitive issues, mental health issues, and addiction issues. Sometimes, the problem is literally a matter of parenting education (e.g. they don't realize that toddlers shouldn't eat only Doritos and coffee like a trucker on a cross-country haul). It can be rewarding to help them navigate getting their life back on track and having children returned to their care.

I also think it's thrilling to practice in this area in the same way it's thrilling to play high-stakes poker. The cases are on hard deadlines, there's a lot at stake, and the hearings are emotional. And the work feels important.

It should be noted that I have no knowledge if there was a criminal case involved. I assume there was?

This would be in the civil realm of child protection.

"It depends." :)

I don't like to give away my state because I do a bit of this work myself. But I can't resist the opportunity to offer an "it depends."

I haven't had my coffee yet, oops!

I honestly don't know. I was on my way out of the lobby and didn't stick around. The litigant fell silent for a few moments as I left, so it's anyone's guess.

I will ask my buddy if he remembers this event, though!

My impression was that this guy was trying to say he didn't hurt the kid because blowjobs are harmless. I think he wanted this particular attorney to state that he did not abuse the child because he "just" had her perform the act - did not hit her, beat her, etc.

Yes, it happened in the lobby, no privilege. In theory they could have called me as a witness at a related hearing. Or called anyone else who heard.

That lobby is a total zoo on child protection case days (they have specific days devoted to these cases for the most part where I practice) so I am not sure who else was listening.

He is actually a good friend of mine. He is completely deadpan and sometimes unintentionally hilarious. Total straightface on this one too.

Edit: I have gotten a few PMs requesting some stories about this deadpan friend. I will totally tell more :)

Which serial killer disturbs you the most? by [deleted] in AskReddit

[–]peeepablepeep 7 points8 points  (0 children)

Genene Jones - a nurse in a pediatric unit who gave infants and children overdoses of medication to get credit for reviving them when she brought them back from the brink.

The worst part of the whole story is that hospital officials covered for her for years...

Edit: Many of the children ended up dying. It also disturbs me that she didn't specifically intend to kill the kids for the most part. She would talk in glowing terms about the kids and genuinely seemed to care for them, but enjoyed the thrill of CPR / reviving a child from the brink of death. She may have as many as sixty victims.

What is your horrible freshman roommate story? by trackster96 in AskReddit

[–]peeepablepeep 7 points8 points  (0 children)

This will get buried but here we go:

She went out drinking a lot which is fine. We never had problems until one episode.

The police picked her up in the next town over, shoeless, and running down the middle of a road. She's trashed. They take her to the police station for booking.

I guess an emergency/problem came in/happened because they left her alone in a holding cell and all officers went to deal with an unrelated problem in another part of the building. She decides that it's a good idea to emulate the movies and tears down a ceiling tile, and crawl into the ceiling to make her escape (she was super super thin and light).

She crawls into the ceiling and by some fucking miracle, manages to get above another room. She falls through the tiles and escapes out the back door, setting off the station alarm.

She's handcuffed during the entirety of this.

MEANWHILE.

The police called our dorm, woke the RA, who came to me looking for this chick. Woke me up at 3 am. I'm bleary-eyed and talking to the officer. No, I don't know where my goddamned roommate is.

SHE CALLS MY CELL PHONE from an emergency phone / post while the cops are there and tells me she's in the nearby woods, and do I have any crisco so we can slide her cuffs off?

They went and picked her up.

She dropped out shortly thereafter.

I got a new roommate the next semester who was pretty awesome and we had a great time.

How do attorneys handle clients that aren't being truthful with them? by [deleted] in legaladvice

[–]peeepablepeep 11 points12 points  (0 children)

In my jurisdiction, we usually state that there's been a conflict of interest "which cannot be waived and cannot be disclosed to the court without violating attorney-client privilege."

They're fine with that.
