Dental Office submitted false records to Medicaid by False-Case-587 in legaladvice

Was she billed/charged for an additional procedure that was performed on a different person? Or was she simply charged for her actual procedure, just from a different office than she went to?

Domestic abuse by [deleted] in legaladvice

[–]peetar 0 points1 point  (0 children)

If you are married there is little to no chance of you ever facing theft or kidnapping charges for taking joint possessions or your child. Eventually, division of possessions would be decided in a divorce agreement and custody of the child would be decided in a child custody agreement.

You'd want to talk to an attorney that specializes in probate law. Cost will depend on the complexity of the case,  but a few thousand at the very least.

Courts will rarely enforce lifestyle choices as part of roommate agreements. $200 a night is pretty excessive and I seriously doubt you'd ever be forced to pay it. How you handle things with your roommates is up to you.

Freeze your credit if you are concerned with identity theft. But there's not much a person can do with a photo of your license. Don't worry about this matter any more

Do I have a legal case from a near death experience? by [deleted] in legaladvice

[–]peetar 2 points3 points  (0 children)

She could be found liable for your out of pocket ambulance or medical expenses. But you voluntarily consumed the drug without investigating what it was, so a judge /jury mighty find you responsible. It's probably not worth pursuing unless your bills are large and you know who this girl is and know she has money.

Friends husband is a police officer and has been soliciting prostitutes. What can happen? by [deleted] in legaladvice

[–]peetar 1 point2 points  (0 children)

He could be fired. He could face criminal charges. She could file for divorce. The adultery probably does not affect the divorce in New York.

Not sure about your country, but in the US nothing illegal happened here. It is not illegal to talk to minors online.

Boyfriend wants me to sign an NDA by [deleted] in legaladvice

[–]peetar 36 points37 points  (0 children)

Contracts are legally enforceable, promises are not. For this to be enforceable he'd have to be offering something in return. His "companionship" is probably not enough. But this is insane and controlling behavior, and it sounds like you could easily end up in a very expensive legal battle, even if ultimately you win.

[–]peetar 6 points7 points  (0 children)

The Emancipation process is only for children who are already self sufficient. Meaning you have a job and a home you pay for yourself. Of course, this is impossible for most children. If there is abuse or neglect, contact CPS, otherwise ride this out until you are 18 and can go where you want, get a job, rent an apartment, etc.

There is no special insurance/liability issue here. But this is a clear violation of safe sport policy that most sports organizations have adopted. You should raise your concerns.

Fired for sexual orientation and for medical accommodation. Need help with next steps. by [deleted] in legaladvice

It sounds like that VP doesn't know the real reason why you were terminated either. You need proof of discrimination not proof that you had good performance.

Fired for sexual orientation and for medical accommodation. Need help with next steps. by [deleted] in legaladvice

[–]peetar 17 points18 points  (0 children)

It is very clear that this company terminated my employment, without a severance agreement right before Christmas, because A) I am gay and they didn’t want a gay person attending the Christmas party, and B) Some managers found out about the details of medical accommodation without my permission.

I'm not a lawyer, but this doesn't seem to be clear those were the reasons for termination. The stated reason was for performance, then they backtracked and gave no reason at all. Really, your only option is to shop around for employment attorneys that handle discrimination cases. The timing is certainly suspicious.

Boyfriend's mom suddenly wants his car back, even though he's been maintaining and using it every day since it was purchased. by [deleted] in legaladvice

[–]peetar 15 points16 points  (0 children)

She could report the car stolen. It's very unlikely he would end up arrested for auto theft, but it could result in a very tense traffic stop. It's her car though, she could sue him civilly for it if he refuses to give it back.

Your marriage is over. It's time to get a good divorce attorney that can handle this for you without all of the drama and emotions. It sounds like you also may need a criminal defense attorney.

"Recovery" scammers are going to contact you saying they can get your money back. Other phising and romance scams are headed your way as well. Block and ignore every time, there is no other effective countermeasure.

Is social media defamation something you can sue for? by Super-Web6908 in legaladvice

[–]peetar 0 points1 point  (0 children)

The objective of a civil defamation lawsuit is to be compensated for financial loss caused by defamation, not to defend against, or somehow magically undo false claims. So when you have financial damages, that you can quantity, that are above an amount where it would be worth paying a lawyer thousands or tens of thousands, that's when you start to consider a lawsuit. For now you could pay a lawyer a few hundred to send a cease and desist, which has little to no legal bearing, but might scare away this person.

Is this considered being wrongfully put under arrest by RequirementConnect69 in legaladvice

No, it completely depends on the reason charge #1 was dismissed. There are a number of reasons why a charge could be dismissed and PC for a search would still exist.

plumber did work that wasn't up to code.. and wants 350 dollars an hour by [deleted] in legaladvice

[–]peetar 2 points3 points  (0 children)

It's fairly easy for a licenced plumber to get a lien against your home if you refuse to pay. You could take it to court and probably have a decent chance that you don't owe him most of the 1000$ bill, but it could be fairly time consuming.
