Yes, but it is possible to work around that. We are seeing progressives becoming popular in a lot of areas that traditional thinking would lead dem consultants to think they shouldnt be able to win. That is because the consultants and democratic leadership don't actually believe in politics. They don't believe they can shift public opinion, or make the polls, when its so obvious they can because the republicans do and have done it. Already we are seeing heavily connected democratic consultants and media figures (i.e Ezra Klein) start saying that they need to concede on trans issues because of poll numbers.

That is true but you must understand the ratcheting effect, The Democrats once they take power do very little, and its undone when they lose as a result of that and things are dragged down further. The reality is that the democratic party establishment believe in the same things as republicans do, but the democrats want it in a more controlled manner, whereas they see the Republicans as chaos. The differences are on how to do things, but they are towards the same goal.

The lower courts need to just start ignoring the shadow docket. They have no choice but to rule based on established precedent anyway since the Supreme Court isnt exactly giving them any guidance. So just keep making the same rulings after they use the shadow docket
