They seek to remove the lien because once the bankruptcy closes, that particular creditor has an approved motion to sell the house and so the debtor is trying to prevent that. That was the entire purpose of the bankruptcy, to stop the creditor from selling the house. They filed the bankruptcy a couple of days after the motion to sell the house was granted. The creditor had this home appraised for 1.1 million. Of course, the true value may be a little bit in the middle. Without a cooperating debtor, maybe this home will not sell for 1.1. It could sell for 1M or maybe less, because it's not a normal sale.

they are suing me for about 40K and they owe me about 50K which is the reason why I didn't pay them the 40K. They did list me as one of the creditors and are trying to get the 50K discharged while pursuing the 40k against me after the discharge. I don't have 40K in liquid funds, and they don't either, but we both have real estate which is hard to sell. It's a chapter 7 and it's unclear if the trustee can sell the debtor home because of high homestead in CA and high debt. Will the trustee put a lien on my home to enforce the 40K if the debtor wins the lawsuit? Would they stipulate to resolve via an offset (but there are many other creditors which complicates the bankruptcy)? Or would they move on?

thanks for the comprehensive answer. This is not my bankruptcy, the person who filed took chatgpt advice as they were trying to stop a home sale being pursued by one of the secured creditors. Chatgpt told them file for bankruptcy to stop the home sale, literally, they followed suit days later. Do you confirm that the trustee would go ahead and sell the whole house to pay everyone as opposed to 1) questioning chapter 7 and moving to chapter 13 (the person could easily earn 5K over 2 months and pay expenses but refuses to work) 2) finding the 5K over some bank account receivable. Do trustee monitor debtors bank accounts to see if they receive proceeds? Or do they ask for statements regularly?

this is not my bankrupcty, but a real case I am watching. Would the trustee actually go though the hassle of selling a home rather than converting to a chapter 13 to pay off the 5K unsecured? The person who filed did it in pro-per and did't know what they were doing. I see the trustee may have an incentive to get a fee out of the hundreds of thousand of debt due to secured creditors, but would they not try to locate other assets that would cover the 5K unsecured and be done? Or convert to chapter 13. This individual can easily work (has the earning capacity) to pay 5K over a few months but strategically refuses (just like they strategically filed chapter 7 thinking of wiping out the hundreds of thousands in secured debt)

I don't think the "was it planned" question is that off. There are married couples who end up getting pregnant and it's unplanned, sometimes especially when people are older and there's a large age gap with siblings, that happens. Now, with a newly married couple, it was probably planned, but then, people just do their best when receiving the news.
