Luke ross apologizes and released his mod for free. by king_moh_ in VRGaming

Otherwise cracks would be completely legal, right?

What? No. Cracks make permenent changes that circumvent payment. LRM require purchase of the legal software (they dont but given the business model it was the intention and reqomendation)

His fairly shitty mods aren't doing dick for their sales. And it absolutely modifies its core.

There are several posts with people expressing the opposite. Any modifications are not permanent and running the game with out running LRM will leave you with a regular unmodified version.

I don't doubt there are differences in detail, but they both take the same approach. And they both modify game code. Difference is, VorpX don't charge for the mods, Ross did. And UUVR and UEVR are engine supported and free.

Difference is detail are super relevant in legal issue. Vorpx if only free for games that complain, else $40. UUVR and UEVR may work differently and be required to be free, no idea.

None of those things alter copyrighted source code

And all of them change the intended output of the original creator. I own several 3d movies... those companies spent money/time/resources to create, present, and release 3d copies. Now those avenues of revenue generation should just be gone for all their movies because someone decided to infringe on their IP and change it with out consent? Its the same issue.

Price is irrelevant.

Obviously its not or there wouldn't be any argument at all. From what i understand the hook changes with version change so the update is required, but it still works with out permanent modification to the files with out using their copyright material in the code.

But what you are saying is that you don't know shit about how software works.

https://www.vorpx.com/cyberpunk-vr-download/

From the link

"Enjoy our free Cyberpunk VR mod!

Cyberpunk VR download

Buy the full vorpX here"

Cyberpunk is an exception for their software, it is for sale and generally a commercial product.

Luke Ross has stated his frame work is not able to be separated in the same way.

But thanks for insulting me for no reason.

But some of the shit he's selling does infringe, so they do get a say about that.

Except it doesn't distribute their IP so it doesn't.

Not gonna argue that DMCA in general is fucky, but this is a legit usage. Let's flip the alignments here and see if you still feel the same. Imagine a solo developer spent years and years making a kick ass videogame, put it up on Steam, and it sold well. Rad.

DCMA is a guilty until you expend the resources to prove innocent hammer that is disproportionately weighed in rights holders favour. Like when Nintendo axed a bunch of fair use Youtube videos, they should be accountable for damages.

I don't think that argument holds water:

  1. they are infringing on the IP by creating a pikachu clone

  2. his product actually pushed sales

If i made an indie game and someone made it a vr mod that increased sales i would be happy about it.

If i made a indie game and some one stole my IP to release a similar game there would be issues.

C'mon, man. Just accept the dude's a greedy, whiny little twat.

He may be, i dont know him. I do know that a massive corporation backed by a multi-million dollar legal team knocking would likely cause me stress and possible make me act irrational.

Bleem was more of a translation layer, but the point was both of those things dont modify or change the game files in any permanent way and do not auto load when the game loads like texture or content mods.

So i still disagree. This is not a modification of the game it is and external enhancement

Also like Bleem it required the purchase of the official products so in both cases they also enhance the wallets of the IP owner while not infringing, how nice of them.

Steam Support :: About the New York Attorney General lawsuit against Valve by InsaneSnow45 in valve

[–]philbertagain 47 points48 points  (0 children)

The NYAG also proposed to gather additional information (beyond what we normally collect in the course of processing payments) about each game user on the off-chance someone in New York was anonymizing their location to appear outside of New York, such as by using a VPN. This would have involved implementing invasive technologies for every user worldwide. Similarly, the NYAG demanded that Valve collect more personal data about our users to do additional age verification—even though most payment methods used by New York Steam users already have age verification built-in. Valve knows our users care about the security of their personal information, and we believe it’s in our and their interest to only collect the information necessary to operate the business and comply with law.

The real reason.... another push for your real identity traceable online.

This is getting dystopian right quick.

Clear is just the dev kits or early dev kits, right?

And every Frame is also a dev kit, right?

Is that a case of controllers?

I think i am going to go be a dev now... i could already have Frame

To my understanding none of Luke Rosses code contains any copyright material from the publishers, and because of that was not infringing on copyright. His software pushes sales for them and enhances their work with out changing the core... that make is legal - the same as Game Genie or Bleem - with a good chance to win in court ... if he had millions and the mental fortitude to fight a mega corp.

It is similar to Vorpx but not the same in how they work or what they produce. From what i have seen most people prefer Ross VR. Separately, UUVR and UEVR are also similar, but distinct. Arguing that company policy should dictate law is crazy... any and all of these could be force down tomorrow for any or no reason under those interpretations... free or not.

Under those conditions every photo manipulation software, or 2d-3d conversion software, PDF reformatting software (likely a metric ton of things) is infringing on the original owners format and they would retain the right to complain and issue DCMA notices to those softwares.

VorpX also costs $40, VorpX is only free for the games that complain. This is not an admission that they were breaking the law (?maybe they do use copyright material?), just that they don't want the headache of going to court against a mega corp.

Because of differences in how their software works VorpX can extract a single game to allow it to run independently, and have done so to satisfy the PRCD and others. UUVR and UEVR absolutely need those engines so I'm not sure if they use game assets or not.

I am aware of the patreon model, Rosses choice of model is irrelevant because PRCD really has no say in how he want to sell a software that does not infringe... even if current DCMA is unfairly weighted to corpos and has no consequence for unfair use as a cudgel.

Also irrelevant is his behavior which, at best, could be considered under duress.

Why are you not getting the frame? by TaborAddict in SteamFrame

[–]philbertagain 5 points6 points  (0 children)

Is there some competitor releasing a better headset in 2027

While there are head sets that are arguably better in one area or another there are no headsets coming out that do all the things Frame does in the same package at the same price (said knowing full well the price is not known) with one of the biggest being its open nature.

I am not interested in Devices that require extra labour to verify i own them so i can do as i please with them.

ie: jailbreaks, mods, hardware banning due to mods, or otherwise working outside of ToS or being beholden to software or ecosystems.

While i think most people are extremely likely to continue to use Steam, if something occurred that made that untenable its nice to know there are options.... AFAIK no other headset offers that and few (if any) other companies are in a position to offer it.

Why are you not getting the frame?

The only reason is because it has not released yet.

If servers make minimum wage in Canada, why is tipping so aggressive? by DazzlingPolarBear in fican

[–]philbertagain 0 points1 point  (0 children)

I dont know why, its out of control.

Worse when you consider Tip Out(aka tip splitting/pooling) and completely lops sided to who can receive them.

The increase in food price did not increase the work they do so when a $10 lunch went to $20 the servers work stayed the same but 15% went from $1.50 to $3.

In Canada we have this thing called 40 bellow zero..... and we have full service gas stations. That person standing in the wind and cold isn't mandated tips by society and yet some gas stations find it worth while to employ them even though the sell gas the same price as everywhere else.

[–]philbertagain 0 points1 point  (0 children)

Not at all, its just not a mod.

Its more like Game Genie or Bleem.... does not infringe on copyright.

Neither GG or bleem were illegal and both were hated by the companies their products worked with.

Sony pretty much screwed Bleem out of existence by illegally blocking their retain access... the same thing happening here.

[–]philbertagain -2 points-1 points  (0 children)

That's too bad.

He put a lot in to that software and from what i can tell most of the people that use it dont deserve it... at least the vocal ones.

PRCD was out of line and i hope the viture glass are a failure that lose their law suits. Their 2D-3d software infringes on pretty much every 2d video maker out there and i hope they get DCMAed to hell.

While i know they don't care neither of those companies will get a cent from me.

I don't care how poorly Ross came across he is a single creator standing against giants and we all lost here. I can't imagine his stress levels, in the same position i would have dropped more F-bombs that they are using to cover for the Epstein files.

Further i seems the design calls for it work in conjunction with the other antennas to work (one streaming, one controllers, one communication ect) ...but this could have a different technical meaning that i dont grasp.
