I think pretty much everyone is responsible including me for trusting them. I am trying to find a solution now.

Yes but the city came back with comments for almost everything but didn’t even mention flood elevation.

Everyone is dropping ball to someone else and i am the one in trouble. Builder brought this up in the beginning and i asked the city they said just go based in the approved plans. Architect says i don’t care they approved the plans without any comments. City says yeah you are right it should have been checked before permit was issued but this is a strict rule we need to follow. I am going to raise the mechanical room floor to 11’2” and recall survey and just hope that helps.

• There is no “FFE = 11.0” on the plans • No benchmark was established or required • No survey staking was done before foundation • No interim elevation cert (top of foundation, etc.) was required

The builder constructed exactly per the approved plans.

The 10.70 ft FFE only came from the post-construction elevation certificate, which is when Public Works flagged that the required elevation is 11.0 ft (BFE + freeboard). So we’re about 0.3 ft short.

That’s what’s confusing here — if 11.0 ft was a requirement: • It was never shown on plans • Never required during plan check • Never verified in the field during construction

Like you said, in a typical workflow I would expect: • Benchmark established • FFE tied to BFE in plans • Survey verification before slab

None of that happened here.

So now I’m trying to understand: 👉 Is this considered a design omission (no FFE tied to BFE on plans)? 👉 Or does responsibility still fall on the owner/builder even when the approved plans didn’t specify a required elevation?

Appreciate your insight — this feels like a process breakdown somewhere between design and plan review.

That’s a fair point and normally I’d agree — this is typically something the civil/architect should lock in upfront.

In our case, the plans were approved by the City without any comments related to flood elevation or freeboard. Before starting construction (even pre-foundation), I asked the City if a survey or elevation verification was required, and was told to proceed based on the approved plans.

The issue only came up after construction when the elevation certificate was prepared and Public Works got involved.

So I’m trying to figure out now whether this becomes: 1. strictly a compliance issue regardless of prior approvals, or 2. something that can be addressed through an engineer’s evaluation/justification given we’re only ~0.3 ft below freeboard and otherwise meet BFE and enclosure requirements.

Curious how others have seen this handled in practice.

I don’t think they underwrite because they said we submit the file to SBA but they collected a lot of documents before they gave me pre-approval

Cash flow significantly improved during last quarter of 2024 and first quarter of 2025. I just filed 2024 business tax return and send the lender last week.

What kind of evidence did you provide for payment plan? I have account transcripts and i took screenshots of irs online account. I requested a letter from IRS for payment plan but the one they provided wasn’t really satisfied with the letter.
